{1l6V1 property commonly known as Assessor's Parcel Number 321-420-05 ("PROPERTY" hereinafter), and
more fully described as:
lot.S Southern Hiils Estates of the City of Poway Tract Map 89'-05, in the City of Poway,
County of San Diego, State of:California, accordingcto Map.,thereofNo. 14040, filed'in
the Office of the County Recorder of San Diego county, September 20,2000.
In consideration of the approval by the City of Poway ("CITY" hereinafter) of Minor Development Review
02,66, involving construction of a 4,866 sq. ft. single family as a condition of TTM 89-05, OWNER hereby
agrees to the following:
1 Grading shall be limited to 50 percent of the lot area pursuant/bCity of Po way Resolution P 99c52.
. 2. Il}stallation of fire sprinkler syslem is required in all living struc, tures, Jut, ure.additions, and guesthouse.
3. No portion of any future guest house. shall ever be rente{! or leased as a separate unit, and that no
kitchen facilities shall ever be' installed pursuant to City of Poway Resolution P 92-50.
4. No tennis court as defined by the City of Poway's development co"de may be constructed anywh'ere
on the parcel pursuant to City of Po way Resolution P 99-52.
This Covenanl shall run with the land and be binding upon. aha inure tb the benefilbf the future
owners, encumbrances, successors, heirs. personal representatives, transferees and assigns of the
respective parties.
In the event that ,Minor Development Review Application 02-66 expir~s or is rescinded by City
Council, and~ui.lding permits ~re nev.er obtained. to construct the propose{! addition, CITY shall at the
request of OWNER expunge this COl(enant from the record title of PROPERTY
In .the event of litigation to enforce the provisions of this Covenant, the prevailing party shall be
entitled, to. full reimbursement of all costs, including reasonable.attorneys'fees, from the other party
