COVENANT REGARDING REAL PROPERTY

Henry A. Wojtczak and Ann C. Wojtczak, Husband and Wife as Joint :!,enants:
("OWNERS" hereinafter), are the owners of real property commonly known as Assessor's
Parcel Number 278-437-36 ("PROPERTY hereinafter), and more fully described as:
Lot 100 of City of Poway TraQt No. 4091-R, in Ihe CitY9f Poway, County of San Diego,
State of California, according to the Map thereof No. 11361, fiied in the Office of the County
Recorder of San Diego County on October 24,1985.
In consideration of the approval of a building permit to construct a 625-squar'e-foot game
room on the referenced property by the City of Poway ("CITY"hereinafter), OWNERS hereby
agree that the game room shall never be rented or leased as a separate 'unit, no kitchen
facilities shall be installed and no gas line and/or 220 amperes electrical service shall ever be
installed.
This Covenant shall run with the land and be binding upon and inure 10 the benefit of the
future owners, encumbrancer's, successors, heirs, personal representatives, transferees and
assigns of Ihe respective parties.
In the event that building permits are never obtained 10 construct the proposed game
room atthe request of the OWNERS, Ihe CITY shall expunge this Covenant from the record title
of the PROPERTY
If either party is required to incur costs to enforce Ihe provisions of this Covenant, the
prevailing party shall be entitled 10 full reimbursement of all costs, including reasonable'
attorneys' fees, from the other party The CITY may assign to persons il1}pacted by the
performance of this Covenant the right to enforce IhisCovenant against OWNERS
