Nf THIS TERMlJ'JATION OF LEASE is hereby entered into as of June 10,2003, by 0
and between the POWAY REDEVELOPMENT AGENCY, a public body, corporate and politic
(the "Lessor"), and the CITY OF POWAY, a California municipal corporation (the "Lessee").
RECITALS
A. The Lessee and the Lessor entered into a certain Lease Agreement (the "Lease")Jor
the Poinsettia Mobilehome Parks (the "Property"), dated May 1, 1988, and restated on April 15,
1992, The original Lease was r~corded in the Official Records of San Diego County on August 27,
1991 as Document No, 1991-043803 r,and the restated Lease )"as recorded in the Official Records of
San Diego County'on April 30, 1992 as Docurnent No, 1992-0256131 The Property is legally
described in Exhibit "A" hereto, which is incorporated herein.
B The Lease provides for)he lease of the Property from the Agency to the City, and
also provides, among other things,thatthe City has an option to acquire the Property
C The Lessee and the Lessor now desire to terminate the. Lease, including without
limitation, the City's leasehold interest in the Property and the option to acquire the Property
NOW, THEREFORE, the L~ssee and the Lessor hereby mutually terminate the Lease in its
entirety, and the Lease shall be of no, further force or effect. The Lease shall not constitute an
encurnbrance to title to the Property or bind any future owners of the Property
