the owner of real property, which is commonly known as Assessor's Parcel Number
321-420-09 ("PROPERTY" hereinafter), and more fully described as:
LOT 9, OF THE CITY OF POWAY TRACT MAP NO 89-05, IN THE CITY OF
POWAY, COUNTY OF SAN DIEGO, STATE OF CALIFORNIA, ACCORDING
TO MAP THEREOF NO 14040, FILED IN THE OFFICE OF THE COUNTY
RECORDER OF SAN DIEGO COUNTY, SEPTEMBER 20, 2000
In consideration of theappr.qval of Minor Development Review Application 02-98
by the City of Poway ("CITY" hereinafter), involving .the 90nstruction of a 4,250-square
foot single-family residence as a condition of Tentative Map 89-05, OWNER hereby
agrees to the following:
1) Limitation of any future additions, guesthouse and/or other structures to
one-story elevation. With a maximum building height of 22 feet, unless the
building pad is lowered (for every foot lowered the building height may be
increased by one foot upto a maximum of 35 feet).
2) Installation of a fire sprinkler system is required in all structures with living
space, future additions, and guest house.
3) Restriction of removal of native vegetation in open space area.
4) Maintenance of vegetation in accordance with the City of Poway's
Wildland Fuel Management Plan for zones 2, 3, and 4
5) Restriction of any permanent structures greater than 2-feet in height, other
than fences, waJls, pools, and tennis' courts within zone 4 of the Wildland
Fuel Management Plan.

6) Restriction of permanent structures including, but not limited to, fences,
walls, pools, and gazebos in zones 1 through 3 of the Wildland Fuel
Management Plan.
This Covenant shall run with the land and be binding upon and .inure to the
benefit of the future owners, encumbrances, successors, heirs, personal
representatives, transferees and assigns of the respective parties.
In the event of litigation to enforce the provisions of this Covenant, the prevailing
party shall be entitled to full reimbursement of all costs, including reasonable attorneys'
fees, from the other party.
