In consideration. of the approval ofa biJilding permit toconstnict a 560-sqtJare-foot'game
room/offiCe on the referenced pr<?,perty by the City of poway ("CITY". hereinafter), OWNERS
hereby agree that the game room/office,shall never be rented"or leased as a separate unit; no
kitchen. faCilities' shall be installed and no gas line and/or 220arnperes electrical service shall
ever be installed,
This Covenant,'shall run with the land and be binding l!pon !'Ind inure to the benefit ofthe
future owners, encumbrancers, successors, heirs, personal representatives, transferees and
assigns of the respective parties.
In the event that building permits are never obtained to construct the proposed game
room/office at the request, of the OWNERS, the CITY shall expunge this Covenant from the
record title ofthePROPERTY
If either party is required to 'incur costs to enforce .the provisions of this Covenant, the
prevailing party shall be entitled to full reimbursement of. all' costs, including reasonable
