(hereinafter "GMNTORS") granttoCITY OF POWA Y (hereinafter "GRANTEE"), its successors, or
assigns, the right-of-way and incidents thereto for a public roadway upon, over, under and across 9
that certain real property in the City of Poway, County of San Diego, State of California, described as 7
follows:
(See legal Description Exhibit "A" & Plat Exhibit "8", which is made a part hereof)
GRANTOR hereby further grants to GRANTEE the Temporary Construction Easement and right to
enter arid construct necessary agreed to improvements as part of the proposed construction process
in the areas shown on Exhibit C. this Temporary Construction Easement shall be valid only until the
construction has been accepted by the GRANTEE. After such time, the Temporary Construction
Easement shall become null and void.
RESERVING unto GRANTORS of the,abovedescribed parcel of land, their successors or assigns,
the right to eliminate such slopes ancj/o! arainage structures or portions thereof, when in the written
opinion of the City Engineer of GRANTEE, the necessity therefore is removed by substituting other
protection, support and/or drainage facility, provided such substitution is first approved in writing by
GRANTEE City Engineer
GRANTORS hereby further grant to GRANTEE all trees, growths (growing or that may hereafter
grow), and road building materiiillswithin said right-of-way, togetherwith the right to use the same in
such manner and at sucliiocations, as said GRANTEE may deem proper, needful, or necessary, in
the constructi6n, reconstruction, iniprovement or maintenance of said roadway
The GRANTORS, for him/herself, his/her successors and assigns, hereby waives all claims for
damages except claims by reason of negligence or willful misconduct of GRANTEE, their
sucCessors, assigns, ,agents or'representatives, to GRANTOR~Sremaining property contiguous to
the right-of-way hereby conveyed by reason of the location, construction, landscaping or
maintenance of said roadway"
