COVENANT REGARDING REAL PROPERTY
Kevin J Grimmer and Francine G>Grimmer, Trustees or their Successors iri the trust of
the Grimmer Family Trust u/d/t July 3, 2001, ("OWNERS" hereinafter), are the owners of real
property commonly known as Assessor's Parcel Number 275-032-14 ("PROPERTY
hereinafIef), and more fully described as:
Parcel 6 as shown on Record of Survey Map Nb. 40?6, 'filed in the Office of the County
Recorder of San Diego County, OCtpber 23, 1956, being a portion of Section 25, Township 13
South, Range: 2 West, San Bernardino Base and Meridian, in the City of Poway, County of San
Diego: State ofCalifbrnia, according to United States Government Survey, approved April 22,
1876
In consideration of the approval ofa building permit to construct a 720-square-foot
sIorage building on the referenced property by the City of Poway ("CITY" hereinafter),
OW~ERS hereby agree .that tl}l:!,storage building is non.habitable SRi3ce. Said storage building
shall not be used for commerCial purposes, except in accordance with Ihe Home Occupation
Permit provision as IisIed in SeCtion 17.28.010 of the Poway Municipal Code.
" This Covenant shall run with. the land and be binding upon and inure toIhe benefit of Ihe
future owners, encumbrancers, successors, heirs, personal representatives, transferees and
assigns of the respective parties. "
In the event that building permits are never obtained to construct the proposed storage
building at the request of the OWNERS, the CITY shall expunge this Covenant from the record
title of the PROPERTY
If eiIher party is required to incur costs to enforce the provisions of this Covenant, the
prevailing party shall be entitled to full reimbursement of all costs, including reasonable
attorneys' fees, from the other party The I Y may assign to persons impacted by 'the
