HERITAGE CUSTOM ESTATES ASSOCIATION,.,a California nonprofit mutual benefit
corporation (hereinafter "GRANTOR") hereby granis to CITYOFPOWAY (hereinafter
"GRANTEE"), a GENERAL UTILITY EASEMENT for public and quasi-public utilities and
services, including but not limited to water, sewer, gas, telecommunications, and cable, and
access for the construction 'and maintenance thereof, whether such utilities are operated by
the City of Poway or under contract, lease, statute, or franchis.e with any third party, public or
private; together with the right to assign such easement to others in whole or in partin, upon,
over, under and across the lands described below
Said easement is particularly described as follows:
Lots E, F, G, H, I, J, K, L, M, N, and 0 of City of PQwayTract No 89-13R, The Heritage
Phase 1, Unit 1, according to Map thereof No 13708, filed in the Office of the County
Recorder of San Diego County, December 17, 1998
GRANTOR expressly warrants and represents that GRANTOR has the power to grant this
easement in accordance with its terms.
