~ COVENANT REGARDING REAL PROPERTY

L~ Gary R. Davis, Jr and Maria G, Davis are the owners ("O,^,NE~" hereinafter) of real property
\ described as: LOT 72 OF CITY OF POWAY TRACT NO 89-13R, 'THE HERITAGE, PHASE 1 UNIT 3, IN
THE CITY OF POWAY, COUNTY OF SAN DIEGO, STATE OF CALlF0RNIA, ACCORDING TO MAP
THEREOF NO 14143, FILED IN THE OFFICE OF THE COUNTY RECORDER OF SAN DIEGO COUNTY,
FEBRUARY 12, 2001, and which is commonly known as Assessor's Parcel Number 277-210-09
("PROPERTY hereinafter).
In consideration of the approval of Minor Development ~yie~..t>,pplication 02-6Lby the City. of
.poway ("CITY" 'hereInafter) to construct a single:family home, with a 2,car attached garage and 2-car

detached garage, on the referenced property, 'OWNER hereby agrees thai no General Plan Amendment,
Zone Change, lentative subdivision map or other discretionary land use decision shall be adopted with
respec! ,tothe"prC!perty' that would increase residential density oT intensity of use, or wOlfldpermit an
industrial. or commercial use other than that as permitted by the Rural Residential zoning in effect on the
pJ:operty on November 8, 1988, unless and until such'action.;s approved by ordinance adopted by'the voters
ofthe.,City"at a special or general election, OWNER;hereby further agrees that the lot shall be,restricted to
the LiSe'one singfe-filmily dwelling use and shall exclude any form""of commercial, business, professional,
industrial or multi-dwelling use except for those commercial or business uses normally associated with
residential use and as permitted in the'.Planned Community Plan, and related specifically to the .gqlf course
as designated in the Planned Community Plan.
This Covenant shall run with the land and be binding upon and inure to the benefit of .the .future
owners, encumbrances, s'uccessors, heirs, personal representatives, transferees and assigns of the
respective parties.
In the event that a building perrilit is never obtained to construct the proposed addition; CITY shall at
the request of OWNERS expunge this Covenant from the record title of PROPERTY
If either party is required to incur costs to enfqrce the provisions of this Covenant, the prevailing party
shall be entitled to, full reimbursement of all cos,ts, including reasona~le attorneys' fees, from the other party
The CITY may.assign to persons impacted by the performance of'this Covenant the right to enforce this
Covenant against OWNERS.,
