Stanford Y Yee and Karen Kohatsu Yee, husband and wife, as community property,
PROPERTY OWNERS ("OWNER" hereinafter), are the owner of real property described as:

11914, filed in the Office of the County Recorder of San Diego County, California. October 6,
1987, and which is commonly'.known as Assessor's Parcel Number 275-271-13 ("PROPERTY;'
hereinafter).
In consideration of the approval by the City of Poway ("CITY" hereinafter) of Minor
Development Review Permit (MDRA) 02-60, a requesHo construct a tennis court, tennis court
pavilion, an 1, 111-square,foot; one-story, detached guesthouse with a 484 square foot attached
garage, and. a_543-squareofoot,.pn.e:~tory addition to an, existing ,single-family residence, on a
2:0-iicre lot located at 15750 Paseo Hermosa in Ru'ral'ResiaentiCiLB-:zone, OWNER:hereby
agrees that no portion of the guesthouse shall ever be rented or leased as a separate unit, and
kitchen facilities shall never be installed. No 'natural gas connection or 220V electricity is
permitted in the guesthouse wet bar area,
I This Covenant shall run-with the land and be binding upon '~nd inure to the benefit of the
future owners, encumbrances, successors, heirs, personal representatives, transferees and
assigns of the respective parties.
In the event that MDRA 02-60 expires or is rescinded, by,City Council at the request of
the OWNER, CITY shall expunge this,Covenant from the record'title ofthe PROPERTY
In the event of litigation,to enforce the provisions of this Covenant, the prevailing party
shall be entitled to full reimbursement of all costs, including reasonable attorneys' fees, from the
other party
