In consideration of the approval by the City of poway ("CITY" hereinafter) of Minor
DeVelbpfnehJ Review Applicatidh (MDRA) 00-102, a req'uestto build a_ 799"squ~re"foQ.!,

rented or leased as a separate,unit and no gas line and/or 220 amperes electrical service ,shall
ever be installed for the, use of kitchen facilities,
This Covenant shall run with the land, and be binding upon and inure to the benefit of
the future owners, encumbrancers, successors, heirs, personal representatives, transferees and
assigns ofthe respective parties.
In the event that MDRA 00-102 expires or is rescinded by City Council at the request of
the OWNER, CITY shall expunge this Covenant from the record title of the PROPERTY
In the event of litigation to enforce the provisions of this Covenant, the prevailing party
shall be entitled to full reimbursement of a II costs, includih easonable attorneys' fees, from the
other party
