COVENANT REGARDING REAL PROPERTY
David A, Meyer and Denise 'Marie Meyer, as Joint Tenants, PROPERTY OWNERS
("OWNER" hereinafter) are the,owners of real property described in Exhibit A, which is attached
hereto and made a part hereof and which is commonly known as Ass,essor's Parcel Number
277-201-18, located at 14360 Ciera Court, Poway, California ("PROPERTY" hereinafter), In
consideration of the approval of MDRA99-192, a reC1uest to construct a 433-square foot
guesthouse on the referenced property by the City of Poway, OWNERS hereby agree that no
portion of the guesthouse shall ever be rented or leased, as a separate unit and kitchen'facilities
shall never beiristalled,
This Covenant shall run with the land and be binding upon and inure to the benefit of the
future owners, encumbrances, successors, heirs, personal representatives, transferees and
assigns of the respective parties.
In the event that MDRA99_192 expires or is rescinded by City Council at the request of
the OWNER. CITY shall expunge this Covenant from the record title of the PROPERTY
In the event of litigation to enforce the provisions of this Covenant, the prevailing party
shall be entitled to full reimbursement of all costs, including reasonable attorneys' fees, from the
other party
