A RESOLUTION OFTHE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA,

ACCEPTING,THE DEDICATION OF A PORTION OF LOT 24, WHITEWATER DRIVE,

0F TRACT MAP NO 7791, FOR PUBLIC STREET PURPOSE$
WHEREAS, on Tract Map No. 7791, recorded ,in the office of the Recorder'of San
Diego County on November 7, 1973, the offer of aecjication of a portion of Lot 24,
Whitewater Drive, reservedforJuture street was rejected; and
WHEREAS, a portion of Lot 24, Whitewater Drive, reserved for future street is a
connection segment required for Maverick Estates, City of Poway Tract Map No 97-02;
and
WHEREAS, Section 66477 .2,of the GovernmentGode(Subdivision Map Act) of the
State of California provides thata rejected offer of dedication shall remain open and may
be accepted by resolution at any later date; and
WHEREAS, Section 771 010 of the Code of Civil Propedure provides for the City
Council of the City of Po way to rescind the rejection on behcllfoUhe public ciftheportion of
Lot 24, Whitewater Drive, reserved forfuture street, as shown on Final Map No. 7'791 and
accept same for public street purposes, and
WHEREAS, the City Clerk of the City of Poway is hereby directed to record this
document with the County Recorder of the County of San Diego
NOW, THEREFORE, BEn RESOLVED by the City. Council ofthe City of Po way as
follows:
1 The City of Po way hereby rescinds the rejection and does hereby accept the
portion of Lot 24, Whitewater Drive, reserved for future street, for public
street purposes,
PASSED, ADOPTED, AND APPROVED by the City Council of the City of Poway,
California, at a regular meeting this 1.7th day of December 2002.
