, Mardi J. Folks and DanieIM.,Smith,husband and wife, as joint property, PROPERTY OWNERS
("OWNER" hereinafter), are the"owner oheal property described in Exhibit A, which is attached
hereto and made a part hereofand which is commonly known as Assessor's Parcel Number
277-190-05 ("PROPERTY" hereinafter).
Inconsideration of the approval by the City of Poway("CITY" hereinafter) of Minor
Development Review Permit (MDRA) 02-1 06, a requesjto add a detached 1,065-square-foot
guesthouse and a detached. 782-square-foot garage with storage 'area to developed single-
family property, on a 1.26"acre lot, located at 13650 Whitewoo"d Canyon, within the Planhed
Community zone, OWNER hereby agrees that no portion of the guesthouse shall ever be:rented
or leased as a separate unit, and kitChen facilities shall neVer be installed. No natural, gas
connection or 220V electricity is permitted in the guesthouse wet bar area.
This Covenant shall run with the land and be binding upon and inure to the benefit of the
future owners, encumbrances, successors, heirs, personal representatives, transferees and
assigns ofthe respective parties.
In the event that MORA 02~106 expires or is rescinded by City Council aUhe request cif
the OWNER, CITY shall expunge this Covenant from the record'title of the PROPERTY
In the event qf litigation to enforce the provisions Clf this Covenant, the prevailing party
shall be entilled to full reimbursementof all costs, including reasonable attorneys' fees, from the
other party
