future owriers;, encumbrance's, successors, heirs, personal representatives, transferees and
assignsofthe respective parties.
In ,Ihe event that building permits are .never :obtained, to construct the' proposed
guesthouse at the request. ofthe OWNERS, the CITY shall eXfJunge this Covenant from the
'record title ofthe PROPERTY
If either party is required. to incur costs to enforce the provisions of this Covena[lt, the
prevailing party shall be entitl",d to, full reimburse'menf of all costs, including reasonable
attorneys' fees, from the other party The CITY may ,assjgn'to persons irnpacted by the
