COVENANT REGARDING REAL PROPERTY
Stephen E, Lockwood :and Laurie G. Lockwood, .Husband and Wife as Joint Tenants
("OWNERS" hereinafter), are the owners of real property commonly known as Assessor's
Parcel Nurilbet"320-200-17 ("PROPERTY hereinafter), andmore;fully described as:
LOT 17 OF CITY OF Po.WAY TRACTNP ?8~04R, IN THE CITY OF POWAY,
COUNTY OF SAN DIEGO, STArE OF'CALlFORNIA, ACCORDING TO THE MAP THEREOF
NO 13364, FILED IN THE OFFICE OF THFCOUNTYRECORDER OF SAN DIEGO COUNTY,
OCTOBER 17,1996.
In consideration of the,approvai by the City'of Pow,ay ("CITY" hereinafter) of a building
permit to construct a 499-scjuare~footp()01 house on the refereh'ced property, OWNERS hereby
agree that 'the pool house shall never be rented or lei:lsecj as' a separate unit, no coniplele
kitchen facilities shall oe installed, and no 220 amperes electrical service shall ever be installed.
This Covenantshall,run with the land and be binding upon and inure to the benefit of the

future owners, encumbrance:s, successors, heirs, personal represehtalives, transferees and
assigns ofthe respective parties.
In the event that building p~rmits are never obtained to construct the proposed pool
house a1"the requeslof the OWNERS, the CITY shall expunge this Covenant from the record
title of the PROPERTY
If either party is required. to incur costs to enforce the provisions'ofthis Covenant, the prevailing
party shall be entitled to full reimburserlJE)ntof all costs,. including reasonable attorneys' fees,
from the other party' The CITY may assign to persons' impacted by the performance of this
