COVENANT REGARDING REAL PROPERTY
Ner Tamid Synagogue and Rancho Bernardo Community Presbyterian Church,
PROPERTY OWNERS ("OWNER" hereinafter), are the o't'ners of real property described in
Exhibit A, which is attached hereto and made a part hereof,and which is commonly known as
Assessor's Parcel Number 314-370-37 ("PROPERTY" ,hereinafter). In consideration of the
approval of CUP 02-11and DR02-16 by the City of Poway ("CITY" hereinafter), OWNER hereby
agrees that any remaining habitat on-site, per the approved conceptual grading plan dated
October 4, 2002 on ,file in the Development Services Department, cannot be removed wilhout
City approval.
This Covenant.shall ,run with the land and be binding upon and inure to the benefit of the
future owners, encumbrances, successors, heirs, personal representatives, transferees and
assigns ofthe respective parties.
In theelient thaI CUP 02"11 expires or is rescinded by, City Council at the request of the
OWNER, CITY shall expunge this Covenant from the record title of Ihe PROPERTY
In the event of litigation to enforce the provisions of this Covenant, the prevailing party
shall be entilled to full reimbursement of all costs, including reasonable attorneys' fees, from the
other party
