GRANT OF TEMPORARY CONSTRUCTION EASEMENT
FORSCRE.EN WALL (CITY OFFICES)
Park Creek Homeowners Association (hereinafter "GRANTOR") hereby grants to CITY OF POWAY,
(hereinafter "GRANTEE"), its successors, or assigns, the Temporary Construction Easement and
incidents thereto for construc:;tion of a screen wall, removal of trees and volleyball court across that
certain real property in the City of Poway, County of San Diego, State of California, described as follows:
(The Easterly 15 Feetof Lot 58 Map 9323)
The GRANTOR, hereby further grants to the City of poway the privilege and right to extend excavation
and embankment slopes within the limits of the herein described Teniporary Construction Easement,
where required for the construction of said screen wall, removal' of trees and volleyball court.
The GRANTOR, for him/herself,bis/her successors and assigns, 'hereby waives any claim for any
and all severance damages to 'GRANTOR's remaining property contiguous to the Temporary
Construction Easement resultirig from acts or actions outsid~ the control of the City of Poway or its
subcontractors or its agents.
The GRANTOR hereby further grants to GRANTEE the right to temporarily enter and construct
necessary related improvements as' part of the proposed construction process. This Temporary
Construction Easement, as described,. shall be valid only until tbe construction has been accepted by
the GRANTEE. After such time, the Temporary Construction Easement shall become null and void,
IN WITNESS WHEREOF, the GRANTOR has executed this Easement on this 25th day of February
