COVENANT REGARDING REAL PROPERTY
TLH, LLC, A California Limited Liability Corporation ("OWNER" hereinafter), is the owner of
real property commonly known as 14477 Southern Hills Lane ("PROPERTY" hereinafter), and more
fully described as:
Lot 12 and undivided one-thirteenth (1/13Ih) interest in Lot "C" of City of Poway Tract
Map 89-05, in the City of Poway, County of San Diego, State of California, according to
Map thereof 14040, filed in the Office of the County Recorder of San Diego County,
September 20, 2000.
In consideration of the approval of a Building Permit to construct a 992.square-foot, detached
guesthouseoon-the-referencedcproperty by the City of Poway.C:CITY" hereinafter), OWNER.hereby
agrees that the detached guest house shall never be rented or leased as a separate unit, no complete
kitchen facilities shall be installed, and no gas line and/or 220 ampere electrical service shall ever be
installed in the kitchen area.
This Covenant shall run with the land and be binding upon and inure to the benefit of the future
owners, encumbrances, successors, heirs, personal representatives, transferees and assigns of the
respective parties.
In the event that a Building Permit is never obtained to construct the proposed guest house at
the request of the OWNER, the CITY shall expunge this Covenant from the record title of the
PROPERTY
- If either party is required to incur costs .to enforce the provisions of this Covenant, the
prevailing party shall be entitled to full reimbursement of all costs, including reasonable' attorneys'
fees, from the other party The CITY may assign to persons impacted by the performance of this
Covenant the right to enforce this Covenant against the OWNERS
