COVENANT REGARDING REAL PROPERTY
The Dien Family Revocable Trust UDT dated August 11, 2003 ("OWNER" hereinafter) is
the owner of real property commonly known as Assessor's Parcel Number 275-101-03
("PROPERTY hereinafter), and more fully described as:
Lot 20 of Green Valley Estates Unit No.2, in the City of Poway, County of San
Diego, State of California, according to Map thereof No. 3797, filed in the Office of
the County Recorder of San Diego County on February 5, 1958.
In consideration of the approval of a Building Permit for a detached accessory pool house
at 13550 Willow Run Road, by the City of Poway ("CITY" hereinafter), OWNER hereby agrees that
the detached pool house shall never be rented or leased as a separate unit, no complete kitchen
facilities shall be installed, and no gas line and/or 220 ampere electrical service shall ever be
installed, except for that to be used solely for water heater and heating purposes.
This Covenant shall run with the land and be binding upon and inure to the benefit of the
future owners, encumbrance's, successors, heirs, personal representatives, transferees and
assigns of the respective parties.
In the event that a Building Permit is never obtained to construct the detached accessory
structure at the request of the OWNER, the CITY shall expunge this Covenant from the record title
of the PROPERTY
If either party is required to incur costs to enforce the provisions of this Covenant, the
prevailing party shall be entitled to full reimbursement of all costs, including reasonable attorneys'
fees, from the other party The CITY may assign to persons impacted by the performance of this
Covenant the right to enforce this Covenant against the OWNERS .~
