CC 1999 04-20 CITY OF POWAY, CALIFORNIA MINUTES OF THE CITY COUNCIL REGULAR MEETING APRIL 20, 1999 The April 20, 1999, regular meeting of the City Council of the City of Poway, was called to order at 7:00 p.m., by Deputy Mayor Emery at the City Council Chambers, 13325 Civic Center Drive, Poway, California. PRESENTATIONS Deputy Mayor Emery presented an Employee Service Award to Steve Eckis, City Attorney - 15 years. 6599 Page 2 - CITY OF POWAY - April 20, 1999 PUBLIC ORAL COMMUNICATIONS Alexander Samaras, 17017 Morene St., and Katie McClamma, 12425 Oak Knoll Rd., #l-B, thanked the Council for providing funds for the Poway Teen Recreation Club to attend the Youth Summit. They also requested that a joint meeting be held between the City Council and Teen Recreation Club to establish a list of goals for the Club. Mike Neufeld of the Poway Chamber of Commerce provided Council with an update on the Business Expo. Kendra Jeffcoat of Palomar College provided Council with an update on the College's financial condition in response to an article that was published in the North County Times last week. CONSENT CALENDAR Deputy Mayor Emery stated he had received a request from staff to pull Item 7 from the Consent Calendar. Motion by Councilmember Rexford, seconded by Councilmember Goldby, to approve the Consent Calendar as follows: Ratification of Warrant Register for the pedod of March 29 - April 2, 1999. (401-10) 6. Rejection of Claims for Damages: John T. Keith. (704-13) Approval of $500 Community Contribution for the Poway 4-H Club to attend the National Dairy Goat Show. (1180-05) 9. Receive and file Annual Review of Ali-Way Stop Intersections. (1160-01) 10. Approval of transfer of right-of-way acquired for the construction of Scripps Poway Parkway to the State of California for widening of SR67. (1001-01) 11. Acceptance of Purchase and Installation of Playground Equipment at Valle Verde Neighborhood Park. (401-13) 12. Adoption of Resolution No. P-99-27 - Approving Temporary Use Permit 99-03, Spdng Fest '99 Street Fair, Poway Chamber of Commeme, Applicant: A request for approval to conduct a street fair on Sunday, May 30, 1999 from 10 a.m. to 4 p.m. (203-07) 14. Status Report of Illegal Encampment Activities for first quarter of 1999. (704-10) 14.1 Approval of Kearny Scripps L.L.C. Agreement for Services. (601-01 #1327) Motion carried 3-0 with Mayor Cafagna and Councilmember Higginson absent. Deputy Mayor Emery commended the Poway 4-H Club Members for their work and wished them luck at the National Dairy Goat Show. ITEM 1 (203-01) TENTATIVE TRACT MAP 97-04R APPLICANT: AMES CONTRACTING. INC. Deputy Mayor Emery opened the public headng. Staff report by City Manager Bowersox. This is a request to revise a pad elevation for one lot for a tentative map of fifteen lots of one acre minimum plus one open space lot of + 25 acres on a 50 acre parcel located 200 feet + south of Del Poniente Road/Midland Road at the Midland Road cul-de-sac, west of the San Sebastian Way cul-de-sac and at the northerly terminus of the unpaved portion of the 1.1 mile road extending from Midland Road, north of Twin Peaks Road. The City Council approved the revised pad elevations for five of the fifteen lots on October 27, 1998. There was no one present wishing to speak. Motion by Councilmember Goldby, seconded by Councilmember Rexford, to close the public hearing and adopt Planning Resolution No. P-99-28, entitled "A Resolution of the City Council of the City of Poway, California, Approving Tentative Tract Map 97-04 Revised, Assessor's Parcel Numbers 314-031-06 & 39." Motion carried 3-0, with Mayor Cafagna and Councilmember Higginson absent. 6601 Page 4 - CITY OF POWAY - April 20, '1999 ITEM 2 (203-02) TENTATIVE PARCEL MAP 93-06TE(3) APPLICANT: DONNA LIEBRICH Deputy Mayor Emery opened the public hearing. Staff report by City Manager Bowersox. This is a request for a one year time extension for a previously approved parcel map to divide a 5.02 acre parcel into 4 lots. The property is located on the north side of Lake Poway Road between Riparian Road and Prairie Vista Road. There was no one present wishing to speak. Motion by Councilmember Goldby, seconded by Councilmember Rexford, to close the public hearing and adopt Planning Resolution No. P-99-29, entitled "A Resolution of the City Council of the City of Poway, California, Approving TPM 93-06TE(3), Assessor's Parcel Number 278-170-03". Motion carded 3-0, with Mayor Cafagna and Councilmember Higginson absent. ITEM 3 (203-24) MINOR CONDITIONAL USE PERMIT 92-03(M) APPLICANT: ELKS LODGE NO. 2543 Deputy Mayor Emery opened the public hearing. Staff report by City Manager Bowersox. This is a request to modify an existing minor conditional use permit to allow the following additional uses: the rental of the lodge facility to non-members for events like parties, weddings and bands/concerts; temporary parking of visiting Elk's motor homes in the lodge parking lot; and permit the construction of a small smoking patio at the front of the building. The property is located at 13219 Poway Road. The following person was present wishing to speak: Frank Funa, 13219 Poway Road, inquired about the procedure for obtaining permits for special events and if RV parking was permitted on the streets. City Manager Bowersox stated that staff could provide him with permit applications for special events and that motorhomes could be parked on the street up to 72 hours without being in violation of the law. 6602 Page 5 - CITY OF POWAY -April 20, 1999 Motion by Councilmember Goldby, seconded by Councilmember Rexford, to close the public hearing and adopt Planning Resolution No. P-99-30, entitled, "A Resolution of the City Council of the City of Poway, California, Approving a Modification to Minor Conditional Use Permit 92-03M, Assessor's Parcel Number 317-473-01 thru 05." Motion carried 3-0, with Mayor Cafagna and Councilmember Higginson absent. ITEM 4 (701-04 fl456) ANNUAL DESIGNATION OF INAPPROPRIATE AREAS FOR SECOND DWELLING UNITS IN SINGLE FAMILY RESIDENTIAL ZONES Staff report by City Manager Bowersox. Ordinance No. 456 was adopted to restrict the construction of second dwelling units to areas where public services are adequate and requires an annual designation of inappropriate areas. It is recommended that the Council continue this item until May 4, 1999 at the request of staff. Motion by Deputy Mayor Emery, seconded by Councilmember Goldby to continue the item to May 4, 1999. Motion carried 3-0, with Mayor Cafagna and Councilmember Higginson absent. ITEM 7 (203-07) TEMPORARY USE PERMIT 99-07 CHRISTIAN LIFE ASSEMBLY CHURCH Staff report by City Manager Bowersox. This is a request for a Temporary Use Permit by Christian Life Assembly Church to conduct a youth recreation event on five evenings on the property located at 14047 Twin Peaks Road. Councilmember Higginson arrived at 7:20 p.m. The following people spoke in opposition to the project: Dr. and Mrs. Wishnack, 14543 Tierra Bonita The following people spoke in support of the project: Michael Isaak, 14047 Twin Peaks Rd., representing Christian Life Assembly Church Stephen Cherwa, 14337 Erin Lane One additional speaker slip in support but not wishing to speak was submitted. 66O3 Page 6 - CITY OF POWAY - April 20, 1999 General discussion ensued with Council regarding the placement of the skateboard ramp, hours of the event, noise, and vandalism that is occurring at the neighboring residence. City Attomey Eckis reminded Council that this temporary use permit would only be for five events. In the event the Church requests to make this a permanent event they would need to come back before the Council for a conditional use permit which would require a public hearing. Motion by Councilmember Rexford, seconded by Councilmember Goldby to adopt Planning Resolution No. P-99-31, entitled "A Resolution of the City Council of the City of Poway, California, Approving Temporary Use Permit 99-07" to include conditions that the hours of the events be from 7:00 p.m. - 10:00 p.m., the skateboard ramp be kept away from the neighbors property; and that the ramp be disassembled at the end of an event and stored. Motion carried 4-0 with Mayor Cafagna absent. CITY MANAGER ITEMS 15. City Manager Bowersox commended Mr. Eckis for his years of service to the City. MAYOR AND CITY COUNCIL-INITIATED ITEMS 18. Councilmember Goldby announced that April 19-25 is free transit week for seniors; requested placement on the next agenda a report from staff regarding the construction of a skateboard park and any recommendations from the Parks and Recreation Subcommittee; commended Deputy City Clerk Sherrie Worrell on her creation of the information brochure regarding the process of a City Council meeting; stated that last week was National Volunteer Week and requested that the City do something next year during National Volunteer Week to celebrate and recognize volunteers and their work in the community. 20A. Councilmember Rexford reported that the San Dieguito River Valley JPA has requested the City join with them in opposing the establishment of a juvenile detention facility in the San Pasqual Valley. Motion by Councilmember Rexford, seconded by Councilmember Higginson, to adopt Resolution No. 99-026, entitled, "A Resolution of the City Council of the City of Poway, California Opposing the Establishment of a Juvenile Detention Facility in San Pasqual Valley." Motion carried 4-0, with Mayor Cafagna absent. 20B.
