NOTICE OF AFFORDABILITY RESTRICTIONS ON TRANSFER OF PROPERTY NOTICE IS HEREBY GIVEN, that the Poway Redevelopment Agency (the "Agency"), to carry out certain obligations under the Community Redevelopment Law of the State of California (Health and Safety Code SectIon 33000 et seq.) and the Redevelopment Plan for the Paguay Redevelopment ProJect, has required Poway Meadows, L.P., a California limited partnership (the "Owner") to restrict the use of the Site (as defined below) and imposing certain affordability requirements on the Site as more pmiicularly set forth in the Disposition and Development Agreement between Agency and Owner dated July 17,2007 (the "DDA") As used in this Notice the site shall mean approximately 4 09 acres of property referred to as the "Metate Parcel" and 2.19 acres of property referred to as the "York Parcel", located m the City of Poway, San Diego County, Assessor's Parcel No 317-350-30 and 314-2]3-18, 314-213-19, 3]4-213-20, 3]4-213-21, (collectively the "Site") and further described in Exhibit A, incorporated herein by reference. The affordability covenants and restrictions contained in the DDA include without limitation and as fuliher described in the DDA. 1. Owner must develop or cause to be developed thirty (30) housing units on the Metate Parcel and three (3) housing units on the York Parcel 2. Owner must sell twenty-five (25) of the housing units located on the Metate Parcel and all three (3) of the housing units on the York Parcel to Moderate Income Households for an affordable purchase price. 3 Owner must sell the remaining five (5) housing units located on the Metate Parcel to Lower Income Households at an affordable purchase price Notice of Affordability Restrictions 1552\04\592129.2 0'8-/27 . . 3395 4. Upon the initial sale of each unit, Owner shall cause the applicab,le purchaser to execute an Affordable Housing Agreement. Each Affordable Housmg Agreement shall have a tenn of forty-five (45) years and shall require that the applicable unit may only be sold to another Moderate Income Household or Lower Income Household (as applicable) and shall contain provisions for an affordable purchase pnce. ThiS Notice of Affordability Restrictions on Transfer of Property (the "Notice") is recorded for the purpose of providing notice only, and it in no way modifies the provisions of the DDA. In the event of any conflict between this Notice and the DDA, the terms of the DDA shall prevail A Memorandum of Disposition and Development Agreement has been recorded concurrently herewith agamst the Site as Series No Ub--OLt CJ3 2J1~ , in the official records of the County of San Diego. As the Owner sells each housing unit on the Site, the Agency and Owner will release this notice from title to such unit and concurrently record the Affordable Housing Agreement and a new Notice of Affordability Restrictions on Transfer of Property that applies only to that unit.
