POWAY REDEVELOPMENT AGENCY, A PUBLIC BODY, CORPORATE AND POLITIC, ("Grantor")
for the sum of One Dollar ($1.00), the receipt whereof is hereby aCknowledged, hereby grants to COXCOM,
INC. d/b/a COX COMMUNICATIONS SAN DIEGO, a Corporation ("Granteej its successors and assigns, a
perpetual Easement, and right to construct, place, operate, repair, inspect, maintain, replace, and remove
such underground Telecommunication equipment as Grantee may require from time to time, consisting of
one or more lines of cables, wires, conduits, pedestals, and necessary'fixtures and appurtenances, in, under,
and upon the hereinafter deSClibed Easement, together with the right to ingress thereto and egress therefrom
and across that certain real property, in the County of San Diego, State of Califomia, described as follows:
That portion of the Southeast Quarter of the Northwest Quarter of Section 13, Township 14 South,
Range 2 West. San Bernardino Meridian, in the City of Poway, County of San Diego, State of Califomia, as
described in Parcel .C" of a Boundary Adjustment Certificate of Compliance BA No. 05-02, recorded July 6,
2005, as Document No. 2005-0566608 of Official Records of said County of San Diego.
The said Easement in the aforesaid land, shall be a strip of land, including all of the area lying
between the exterior sidelines, which sidelines shall be three (3). feet measured at right angles on each
exterior side of each and every Telecommunication Facilities installed within said property on or before April
30,2007
Grantee shall be liable to 'Grantor for any damages, which may occur to the above described property, by
reason 01 negligence on the part of the employee of the Grantee, while placing, maintaining, or removing its
selVices.
This agreement shall be binding upon and inure to the benefit~ of the heirs, successors in interest and assigns
of both parties.
