In consideration of the approval by the City 6f Poway ("CITY" hereinafter) of Yariallc~

square feet onto an existing. single"family residence:and construct a 460-square-foot detached pool
house, OWNER hereby agrees;t~at no"portion of the pool house shall ever be rented or leased as
a separate unit, and complete kitchen facilities shall never be'installed, which .means that no
natural gas connection or 220V electricity is permitted in the kitchen area.
This Cove'nant shall run with the land and be binding upon and inure to the benefit. of the
future owners, encumbrancers, successors, heirs, personal. representatives, transferees and
assigns of the respective parties.
In the event that VAR 07-1'0 and,MbRA 07-32 expires or is'rescinded by City Council at the
request of the OWNER, CITY shall expiInge'this Covenant from the record title of the PROPERTY

In the ev.ent of litigation to enforce the provisions of this Covenant, the prevailing party
