and Karen E, Carlson Living Trust, dated March 11, 1994, ("OWNER" hereinafter), is the owner
of real property commonly known as 17009 Dos Amigos Way ("PROPERTY hereinafter), and
more fully described in Exhibit A.
In consideration of the approval of a Building Permit for an attached single-story, 743-
squarecfoot second dwelling unit, by the City of Poway ("CITY" hereinafter), OWNER hereby
agrees that the second dwelling unit shall' never be rented or leased as a separai'e unit, no
complete kitchen facilities shall be installed, and no gas line and/or 220 ampere electrical
service shall ever be installed, except for that to be used solely. for 'water heater and heating
purposes,
This Covenant shall rU,n with the tand and be binding upon and inure to the benefit of the
future owners, encumbrance's, successors, heirs, personal representatives, transferees and
assigns of the respective parties,
In the' event that'a Building permihs never obtained to construct. the. detached accessory- . - -. '
structure at the request of the OWNER, the CITY shall expunge this Covenant from the record
title of the PROPERTY
If either party is required to incur costs to enforce the provisions of this Covenant, the
prevailing party shall be entitled to full reimbursement of .all costs, including reasonable
attorneys' fees, from the other party The CITY may assign to persons impacted by the
performance of this Covenant the right to enforce this Coitenantagainst the OWNERS
