RESOLUTION NO 08-024
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF POWAY, CALIFORNIA,
ORDERING THE SUMMARY VACATION OF A PORTION
OF AN IRREVOCABLE OFFER OFDEDICATION
FOR ROADWAY PURPOSES
IN PARCELS 1 AND 2, PARCEL MAP NO 8808
(Vacation No 07-04)
WHEREAS, the City Council of the City of Poway desires to summarily vacate a
portion of an Irrevocable Offer of Dedication (IOD) for roadway purposes in Parcels 1
and 2, Parcel Map No 8808 in accordance with the procedures provided in Chapter 3,
Part 3, Division 9 of the Streets and Highways Code of the State of California,
commencing at Section 8330; and
WHEREAS, said IOD was granted to the County of San Diego per document,
identified as, File/Page 78-397116, recorded September 18, 1978, of Official Records;
and
WHEREAS, the City of Poway became the successor in interest to said IOD
upon its incorporation in December 1980; and
WHEREAS, said 100 was not perfected for dedication of public street right-of-
way as private streets were created and subsequently improved to serve the immediate
adjacent properties.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway
as follows.
1 This summary vacation is made under-the. provisions of Chapter 3, Part 3,
Division 9 of the Streets and Highways Code of the State of California.
2. The City Council hereby finds that the Irrevocable Offer of Dedication for
Roadway Purposes is an excess right-ofcway not required for street
purposes (Section 8334a)
3 The City Council hereby declares that a portion of an Irrevocable Offer of
Dedication (IOD) for roadway purposes .in Parcels 1 and 2, Parcel Map
No 8808, more particularly described in ExhibitA and depicted on Exhibit
B, attached hereof, is hereby vacated.
4 The City Clerk of the City of Poway is hereby directed to cause a certified
copy of this Resolution to be recorded in the office of the Recorder of San
Diego County in accordance with the provisions of Section 8336 of the
Streetand Highways Code of the State of California.

5 That from and after the date the Resolution is recorded, said portion of the
Irrevocable Offer of Dedication in Parcels 1 and 2, Parcel Map No. 8808
no longer constitutes an offer of dedication for roadway purposes.
PASSED, ADOPTED, AND APPROVED by the City Council of the City of
Poway, California, at a regular meeting this 15th day of April 2008
