Ronald H. Sartore and Lvnn Sartore, PROPERTY- OWNER ("OWNER" hereinafter) is

part hereof.and which is commonly known as Assessor;s Parcel Nurnber 277-210-06
("PROPERTY" hereinafter) and more fully described as Exhibit A.
In consideration .of the approval BY THE city of Poway, ("CITY" hereinafter) of
/ Minor Development Review.02~22 (MDRA 02-22), involving a 580 square-fbotdetached
guest house, OWNER hereby agrees that no portion of the glJest house shall ever bE1
rented or leased as a separate unit, and thatno kitchen,facilities shall ever be installed
This Covenant shall run with the land and be binding upon and inure to the
benefit of the future owners, encumbrancers, successors, heirs, personal
representatives, transferees and assigns of the res'pective parties.
In the event that Minor Development Review 02-22 expires or is' rescinded by
City Council, and building permits are never obtained to construct the proposed
guesthouse, CITY shall expunge this Covenant from the record title of the PROPERTY
In tile event of litigation to enforce the provisions pf this Covenant, the 'prevailing
party'shalLbe entitled to full reimbursement of all. costs, including reasonable attorneys'
fees, from!he other"party
