B. The CITY adopted Resolution No. P-0'1-6:1 ("RES0LUTI0N" hereinafter) in connection
\yith its approval:ofthe'yariance 01':01 (V ARO,1"01 ),and Minor:Develcipmefit Review Application 01-08
(MORA 01c08) for the development of a single-family residence with a 25,foot front yard setback on
the PROPERTY; which sets forth certain conditions to the approval forVAR01-01 and MDRA 01-08,
C In compliance with:Condition D 11 of Section 11 of RESOLUTION:
1. The Fire Ma"nagement.Zonesfor PR0PER'fY'are located as delineated on the
approved gra~ing plan (G-1348) on. file with the City Development Services
Department. Amendments to the Fire ManagElment.Zonesfor PROPERTY are
subject to approvaL by the City" the Fire Management Zones must be
landscaped and maintained in accordance with the City of poway Guide to
Landscape-Requirements.
2. RemovaLordisturbance of any portion of the Costal Sage,Scrub Habitat located
lower than tfl"e 666' elevation contour line of PROPERTY, and approximately
delineated,by'the limits of Zone 3 of'the Fire Management Zone and the leach
field shown. on the approved grading plan (G-1348) on file with the City
Development Services Department, isprohibited.lmless reviewed and approved
by t1ieGity of Poway in accordance with the poway Subarea Habitat
Conservatic:m Plan.
NOW THEREFORE, in cOIl~ideration of the mutual .covenants and agreements contained
herein and for other valuable consideration, the CITY and -OWNER agree as set forth below'
1 Enforcement. Violation or breach of any ,covenant, AGREEMENT or provision

made: 'the "right .to prosecute a' proceeding at law or' in equity against the person or persons 'who

prevent them from doing so, to cause 'such violation to be remedied and/or to recover damages for
such violation.
2. Rights of Lenders. No breach or violation of the terms of this AGREEMENT shall
defElat or render ir'(valid the lien of-any mortgage, deed of trus! or similar instruments securing a loan

3. Invaliditv of a Provision. If a court. of competent jurisdiction adjudges any provision
ofthis AGREEMENrto be illegal or ufienforceableforany reason, that rUling shall, io the maximum
extent permitted by ,law, in no way affect any other provisionl of this. AGREEMENT, the.application of
any provisib'n undereircumstances d"ifferent from those adjudicated by the court, or the vaiidity or
enforceability of the AGREEMENT as a whole.
4 Covenants Running With the Land.. All: of the provisions, agreements, rights,
powers, covenants, conditions, restrictions, and obligations contained in this AGREEMENT shall be

successive owner of the PROPERTY In the event the lots,are sold by OWNER to more than one
purchaser, each such purchaser shall be jointly and severally liable for the obligations of OWNER
hereunder

laws of the Sate of California.
