~ COVENANT REGARDING REAL PROPERTY
Luke and Lori Farmer, husband and wife, as community property ("OWNERS"
hereiDafter), a[~ ,the, owners of refjl property commonly known as Assessor's Parcel
Number 276-080-52. ("PROPERTY" hereinafter), and more fullY described in Exhibit "A"
In consideration of the approval, of Underground Waiver 02-05', by the City of
Poway ("CITY" hereinafter), OWNER hereby agrees for the benefit of the City; not to
oppose any future, private or public utilities undergrounding district, and to pay apro rata
share' of future undergrounaing costs,
This Covenant shall run with the land and be binding upon and inure to the
benefit of the flcitUre -owners, encumbrances, successors, heirs,_ personal
representatives, transferees and assigns of the respective parties.
If either party is required to incur costs to enforce the provision of this Covenant,
the prev~iling party shalib~erititled to full reirilbursl?~ent of all costs, incluidng
reasonable attorneys' .fees, from the other part. The CITY may assign to persons
impacted: by the performance, of this Covenant the right to enforce this Covenantagaihst
