CmiENANTREGARDING REAL PROPERTY
David A. Good and Kellie E.Good, as Trustees ofthe Good'Family Trust dated February 1, 1995,
are the owners ("OWNER" hereinafter) of real property commonly'known as Assessor's Parcel Number
317-591-55-00 ("PROPERTY hereinafter), and more fully described as.
Lot 115 of Heritage Hills Unit No.3, in the City of Po way, County of San Diego, State
of California, according to f\;1ap thereof No 6250, tiled in the office of the county
Recorder of San Diego County December 24, 1968.
In cOj1sideration of th.e .approval by the City of Poway ("CITY" hereinafter) of a Minor
Development Review (MDRA 01-57) to construct a 1200-square-foot two-story addition, OWNER hereby
agrees that no portion of the two-story addition shall ever be rented or leased as a separate unit and no
kitchen facilities shall ever be installed.
This Covenant shall run with, the land and be binding upon'and inure to the benefit of the future
owners, encumbranc!"s, successors, heirs, personal representatives, transferees and assigns of the
respective parties.
In the event that a.building permit is never obtained to constructthe proposed addition, CITY shall
at the request of OWNERS expunge this Covenant from the record title of PROPERTY
If either party is required 10 incur costs to enforce the provisions of this Covenant, the prevaHing
party shall be entitled to full reimbursement of all costs, including reasonable attorneys: fees, from the
other party The CITY may assign.to persons impacted by the performance of this Covenant the right' to
enforce this Covenant against OWNERS.
