GRANT OF EASEMENT
FOR SCREEN WALL (CITY 0FFICESPHASE I)
Bruce R.and Kathleen, A cleqq, Husband and Wife as Joint Tenants (hereinafter
"GRANTOR") hereby grants 'to CITY OF P0WAY, (hereinafter "GRANTEE"), its
successors, or assigns, an easement and incidents thereto for construCtion ofa screen
wall and landscaping upon, over, and across that certain real property in the City of
Poway, County of San Diego, State of California, described as follows:
(See Attached Exhibits A and B)
The GRANTOR, hereby further grants' (0, the City of Poway the privilege and right to
extend excavation within the limits ofthe herein described easement, where required for
the construction and maintenance of said screen wall and City street. The City will
install and maintain landscaping in said easement, as shown on landscape plans for the
City Office Buildings Ph.ase 1
The GRANTOR hereby further grants to GRANTEE all 'trees, growths (growing or that
may hereafter grow), within. said e9sement , together'VI(ith the right to use the same in
such manner and at such locations as said GRANTEE may deerri proper, needful or
necessary, in the construction; reconstruction, improvement or maintenance of said
screen wall.
The GRANTOR, for hirri/herself, his/her successors and assigns, hereby waives any
claim for any and all severance damages' to GRANTOR'sremaining property contiguous
to the right-of-way hereby c6mieyed by reason of thelocatibn, construction, landscaping
or maintenance of said screen wall.
