GRANT OFTEMPORARY CONSTRUCTION EASEMENT
FOR SCREEN WALL (CITY OFFICES PHASE I)
Mark P. and Danielle Nespeca,Husband and Wife as Joint Tenants (hereinafter "GRANTOR")
hereby grants to CITY OF POWAY, (hereinafter "GRANTEE"), its successors, or assigns, the
Temporary Construction .Easement and incidents thereto for construction of a screen wall
across that certain real property in the City of Poway, County of San Diego, State of California,
described as follows:
(The Easterly 15 Feet of Lot 19 of Map 9323)
The GRANTOR, hereby further grants to the City of poyvay the privilege and right to extend
excavation ahdembankment slopes within the limits of the. herein described Temporary
Construction Easement, where required for the construction of said screen wall.
The GRANTOR, for him/herself, his/her successors and assigns, hereby waives any claim for
any and all severance dam<lges to GRANTOR's. remalnjng property contiguous to the
Temporary Construction Easement. Said severance damage relates to the market value of the
home.
The GRANTOR hereby further;grants,to GRANTEE the right to temporarily enter and construct
necessary re!ated improvements as part ofthe pr()posedconstruction process. The GRANTEE
accepts liability for the construction activity therein. This Temporary Construction Easement, as
des9ribed; shail be valid only until the.construction has been accepted by the GRANTEE. After
sud'i time, the Temporary Construction Easemeht.shalLbecome null and void.
