In consideration of the approval of Minor Development Review Application (MDRA) 01-102R, by the City of poway ("CITY" hereinafter), OWNER hereby acknowledges that the barn on Parcel 1 is an accessory use to the residence on Parcel 3 and that the barn shall not be used as a dwelling unit. It is further acknowledged that Parcel 1 and Parcel 3 shall remain under the sarne ownership (I.e., not separately owned) unless the barn has been removed to the satisfaction of the Director of Development Services, or a Minor Development Review Application (MDRA) for a residence has been issued for the barn site (Parcel 1). This Covenant shall run with the land and be binding upon and inure to the benefit of the future owners, encumbrancers, successors, heirs, personal representatives, transferees and assigns of the respective parties. In the event that MDRA 01-102R expires or is rescinded by City Council at the request of the OWNER, or unless the barn has been removed to the satisfaction of the Director of Development Services, or a Minor Development Review Application (MORA) for a residence has been issued for the barn site (Parcel 1), the CITY shall expunge this Covenant from the record title of the PROPERTY. In the event of litigation to enforce the provisions of this Covenant, the prevailing party shall be entitled to full reimbursement of all costs, including reasonable attorneys' fees, from the other party.
