Res P-08-31 RESOLUTION NO P-OS-31 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA APPROVING DEVELOPMENT REVIEW OS-04 APN: 317-550-05 WHEREAS, Development Review (DR) OS-04, submitted by Oak Knoll Housing, LP, commonly known as Community Housing Works, a request for approval of a new 600-square-foot community building, and a major renovation of an existing 52-unit apartment complex located at 12509 Oak Knoll Road, in the Residential Apartment (RA) zone, and WHEREAS, on November 1S, 200S, the City Council held a duly advertised public meeting to solicit comments from the public, both pro and con, relative to this application. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Poway as follows Section 1 This project is exempt from the California Environmental Quality Act (CEQA), as a Class 1 Categorical Exemption, pursuant to Section 15301 of the CEQA Guidelines, in that the project involves interior and exterior modifications to an existing project, and a small addition to the project which will result in a negligible expansion of the use. Section 2. The findings for DR OS-04, in accordance with Chapter 17 52 of the Poway Municipal Code, are made as follows. A. The new building and exterior renovation is consistent with the Zoning Ordinance and General Plan in that it involves the renovation of an existing residential project that will bring the project into closer compliance with City design standards, therefore, the project respects the interdependence of land values and aesthetics to the benefit of the City B The new building and exterior renovation will not have an adverse health, safety, or aesthetic impact upon adjoining properties in that the project is in compliance with all City development standards C The exterior renovation is in compliance with the Zoning Ordinance in that the exterior renovation will bring the building into compliance with City design standards D The development encourages the orderly and harmonious appearance of structures and property within the City Section 3 The findings, pursuant to Government Code Section 66020 for the public improvements for DR OS-04, are made as follows Resolution No P-OS-31 Page 2 A. The design and improvements of the proposed development are consistent with all elements of the Poway General Plan, as well as City Ordinances, because all necessary services and facilities will be available to serve this project. Section 4 The City Council hereby approves DR OS-04, for a new 600-square-foot community building, and a major renovation of an existing 52-unit apartment complex located at 12509 Oak Knoll Road, in the Residential Apartment (RA) zone, as shown on the site plan dated July 30, 200S, and exterior elevations dated September 26, 200S, subject to the following conditions A. Approval of the project shall apply only to the subject project, and shall not waive compliance with all sections of the Zoning Ordinance and all other applicable City Ordinances, in effect at the time of Building Permit issuance. B Within 30 days of the date of this approval or before submittal of a Building Permit application, whichever occurs first, the applicant shall submit in writing that all conditions of approval have been read and understood C The conditions for the project shall remain in effect for the life of the subject property, and shall run with the land and be binding upon future owners, successors, heirs, and transferees of the current property owner D The project shall be developed in accordance with the approved plans dated July 30, 200S, which include the revised project exterior elevation dated September 26, 200S, on file in the Development Services Department and the conditions contained herein. E. Prior to construction, the applicant shall obtain a Building Permit. Prior to issuance of a Building Permit, the applicant shall comply with the following: (Engineering) 1 Remit a payment of $545 for the minor engineering site inspection fee 2. Post a $2,000 sediment control cash security deposit with the Engineering Division for emergency purposes 3 Remit a payment of $2,356 for sewer impact. 4 Attend a pre-construction meeting with the Engineering Inspector for Action Plan implementation to address erosion prevention, and sediment control during construction Erosion prevention measures shall be installed and maintained by the applicant throughout construction. (Planning) 5 The applicant shall comply with the latest adopted Uniform Building Code, National Electric Code, and all other applicable codes and ordinances in Resolution No P-OS-31 Page 3 effect at the time of Electrical/Building Permit issuance 6 Paint, accent tile, awning material, and stone veneer samples, consistent with those shown on the approved project plans, shall be submitted to the City for review and approval before Building Permit application submittal. Approved colors and materials shall be noted on the building plan check submittal. 7 The proposed Community Building exterior shall be enhanced to incorporate architectural features consistent with the features provided on the street side elevation, as shown on the approved architectural elevation plans dated September 26, 200S Enhancements shall be shown on the building plan check submittal. S Submit detailed landscape and irrigation plans to the Planning Division for review and approval. Approval of plans is required before the issuance of a Building Permit. A landscape plan check review fee is required at the time of initial submittal of the plans The plans shall be prepared pursuant to the City of Poway Guide to Landscape Requirements and the RA zoning standards and specifications for tree planting. Street trees shall be provided in accordance with requirements listed in the City of Poway Guide to Landscape Requirements. 9 The applicant is to contact the Poway Unified School District to verify if school impact fees for the additional building on the site are required If required, school impact fees shall be paid at the rate established at the time of Building Permit issuance Please contact the Poway Unified School District for additional information at (S5S) 679-2570 10 A detailed site lighting plan (which is a separate item from the Building plan check submittal) shall be submitted for the review and approval of the Director of Development Services The plan shall show all project lighting and generalized specifications/notes that show all new lighting complies with the following: a. All outdoor lighting fixtures, including, but not limited to, illuminated signage, decorative building or landscape lighting, illuminated recreational facilities or common outdoor areas, and parking lot lighting shall be turned off between the hours of 11.00 p.m and sunrise, except when used for security purposes Automatic timing devices shall be integrated into all new or modified lighting systems to turn off at 11.00 p.m. b All lighting used in the parking lot shall be low-pressure sodium. c Lighting fixtures shall be designed to integrate with the project's architectural design concept. Freestanding lamp posts shall be no taller than 18 feet. e The intensity of light at the boundary of the housing project site shall not create glare or otherwise shine onto nearby residential properties 11 Re-striping of the parking lot is to be in compliance with City standards. Prior to issuance of Building Permit, the applicant is to submit an exhibit showing typical striping for review and approval. Additionally, tire stops shall be provided on parking stalls in situations where a tire stop is necessary to protect landscape areas and to preclude a vehicle from hitting a wall or fence Striping and tire stop installation is to be completed before issuance of Certificate of Occupancy 12. Signs (wall mounted, monument, on-site directional), if proposed, are not a part of this approval and require separate review and approval of a Sign Permit. F The following improvements shall be constructed to the satisfaction of the City Fire Marshal: 1 Roof covering shall be fire retardant as per CBC Section 1505, and City of Poway Ordinance No 64 and its amended Ordinance No 526 2. The building shall display its numeric address in a manner visible from the access street. 3 Every building hereafter constructed shall be accessible to Fire Department apparatus by way of access roadways with all-weather driving surface of not less than 20 feet of unobstructed width, with adequate roadway turning radius capable of supporting the imposed loads of fire apparatus having a minimum of 13'6" of vertical clearance This 20-foot access width is the minimum required for Fire Department emerqency access In most cases, City Engineering standards will be more restricting. The more restrictive standard shall apply The City Engineer, pursuant to the City of Poway Municipal Code, shall approve the road surface type. 4 Fire Department access for use of firefighting equipment shall be provided to the immediate job construction site at the start of construction and maintained at all times until construction is completed 5 Permanent access roadways for fire apparatus shall be designated as "Fire Lanes" with appropriate signs and curb markings Resolution No P-OS-31 Page 5 6 Minimum 2A.10BC fire extinguisher required for every 3,000 square feet and 75 feet travel distance. 7 For any roofing that requires "hot work", a permit shall be obtained from the Fire Department prior to the start of roofing. Provide note on plans. G Prior to the City's approval for occupancy and release of securities, unless other timing is indicated, the following conditions shall be satisfied 1 The site shall be developed and the building elevations shall be constructed in accordance with the approved plans on file in the Development Services Department and the conditions contained here. A final inspection from the appropriate City Departments will be required. Section 6 Pursuant to Government Code Section 66020, the 90-day approval period in which the applicant may protest the imposition of any fees, dedications, reservations, or exactions imposed pursuant to this approval shall begin on November 1S, 200S Section 7 The approval of Development Review OS-04 shall expire on November 1S, 2010, at 5.00 p.m., unless, prior to that time, a Building Permit has been issued and construction on the property has commenced prior to its expiration PASSED, ADOPTED and APPROVED by the City Council of the City of Poway, State of California, this 1Sth day of November 200S Michael P Cafag '-;TEST ~ ran, MMC, City C erk Resolution No P-OS-31 Page 6 STATE OF CALIFORNIA ) ) SS COUNTY OF SAN DIEGO ) I, Linda A.
