ORDINANCE NO 681
AN ORDINANCE OF THE CITY OF POWAY, CALIFORNIA,
AMENDING SECTION 12.48.250 OF THE POWAY MUNICIPAL CODE
TO ADD ONE ADDITIONAL PROPERTY
WHEREAS, it is desirable to underground existing overhead utilities at the same
time as the planned road and drainage improvements on Oak Knoll Road from Poway
Road to 765 feet west of Carriage Road The proposed boundaries of the underground
district ("District") are as shown on the attached drawing (Exhibit "A") attached hereto
and incorporated herein, and
WHEREAS, Section 12.48030 of the City of Poway, California, Municipal Code
permits the establishment of an Underground Utility District by Ordinance amending the
Municipal Code "if after such public hearing on the Resolution of Intention, the City
Council finds that the public health, safety, or welfare requires such removal and such
underground installation within a designated area", and
WHEREAS, the City of Poway held a public hearing on the Resolution of
Intention on June 10, 2008, introduced an Ordinance establishing the boundaries of the
District on July 1, 2008, and adopted the Ordinance on July 15, 2008; and
WHEREAS, following the adoption of the Ordinance establishing the boundaries
of the District on July 15, 2008, the City was notified that the boundaries of the District
need to be modified to include an additional property; and
WHEREAS, the purpose of this Ordinance is to modify the boundaries of the
District established on July 15, 2008, to add one additional property to the District.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF POWAY DOES
ORDAIN AS FOLLOWS
Section 1 Section 12.48.250 shall be added to the Poway Municipal Code
designating the following as Underground Utility District No 66.
All that unincorporated territory in the County of San Diego, State of California lying
within the following described boundaries.
Beginning at the Southeast corner of Section 15, Township 14 South, Range 2 West,
San Bernardino Meridian, thence Northwesterly along the Southerly line of Assessor
Parcels 316-120-08 and 316-120-19 to the Southwesterly line of said Assessor Parcel
316-120-19; thence along said Southwesterly line to the Northwesterly line of said
Assessor Parcel 316-120-19; thence along said Northwesterly line to a point of
intersection of the Southeasterly right-of-way of Poway Road and the Southwesterly
right-of-way of Oak Knoll Road, thence Northeasterly to the Southerly point of curve of a

2500 foot radius curve, concave Easterly on Assessor Parcel 316-120-16, said point
being on the Northeasterly right-of-way of said Oak Knoll Road, 2000 feet half width
from centerline, thence along said Northeasterly right-of-way to an angle point as shown
on Assessor Parcel 317-151-59; thence Northerly to a point 3000 feet measured at
right angle to the centerline of said Oak Knoll Road, thence along said Northeasterly
right-of-way to the Southwest corner of Parcel 1, Parcel Map No. 16072, thence along
the Westerly line of said Parcel 1 to the Northwest Corner of said Parcel 1, thence along
the Northerly line of said Parcel 1 to the Northeast corner of said Parcel 1, thence along
the Easterly line of said Parcel 1 to the Southeast corner of said Parcel 1, said point
being on the Northerly right-of-way of said Oak Knoll Road, thence along said Northerly

foot radius curve, concave Northeasterly, said 2500 foot radius curve being the
Southwest corner of Assessor Parcel 317-540-36, said point of curve being on the
Northerly right-of-way of Oak Knoll Road; thence Easterly along said Northerly right-of-
way to the Southeast corner of Assessor Parcel 317-540-35, thence Northerly along the
Easterly line of said Assessor Parcel 317-540-35 to the Northeast corner of said
Assessor Parcel 317-540-35, thence Westerly along the Northerly line of said Assessor

Section 2. This Ordinance shall be codified
EFFECTIVE DATE. This Ordinance shall take effect and be in force thirty (30)
days after the date of its passage, and before the expiration of fifteen (15) days after its
passage, it shall be published once with the names of members voting for and against
the same in the Poway News Chieftain, a newspaper of general circulation published in
the City of Poway

Introduced and first read at a Regular Meeting of the City Council of the City of
Poway held the 7th day of October 2008, and thereafter PASSED AND ADOPTED at a
regular meeting of said City Council held the 18th day of November 2008, by the
following roll call vote
