William P Hummel and Wendy Mason,Hummel, Owners, ("OWNER" hereinafter) of land described
in Exhibit AJ:",hich is attached heretoaQ,d.rJ1ade,t'l part hereof and whic~ is commonly known as Assessor's
Parcel Number 275'260,52 and 5.3 "PROPERTY(her,einafter), In .consideration of the approval of Minor
Development Review,gg,46 and an approved building permiito construct a pool housel guest house as an
accessory structure on the referenced property by the City of Poway .(:'CITY" hereinafter), OWNER hereby
agrees that no portion ofthe pool house Igues(house shall ever'be'rented or leased as a separate unit and
complete kitchen facilities shall never be'installed.
This Covenant shall run with,theilaild and be bin'ding .upon and inure to the benefiLofthe future
owners, encumbrancers, successors, heirs, personal rep'resentatives; transferees and assigns of the
respective parties.
In the event that building permits, are never obtained to construct the proposed guest house at the
request of the OWNER, the CITY shall expunge this Covenant from the record title of the PROPERTY
If either party is required ,to incur costs to enforce the provisions of this Covenant, .theprevailing party
shall be entitled to full reimbursement of'aHco,~ts, including reasonable attorneys' fees, from the other party
The CITY may assign to persons impacted by the performance ofthis Covenant the right to enforce this
Covenant'against OWNER.
