CC 1999 11-30 CITY OF POWAY, CALIFORNIA MINUTES OF THE CITY COUNCIL REGULAR MEETING NOVEMBER 30, 1999 The November 30, 1999, regular meeting of the City Council of the City of Poway, was called to order at 7:00 p.m., by Mayor Cafagna at the City Council Chambers, 13325 Civic Center Drive, Poway, California. PUBLIC ORAL COMMUNICATIONS Mayor Cafagna explained the procedure for Public Oral Communications. The following people were present wishing to speak: Ed Carboneau, 14073 Pomegranate Ave., expressed his views on payroll services for mobile home park staff. 6786 Page 2 - CITY OF POWAY - November 30, 1999 Kevin Patrick Campbell, 13029 Earlgate Ct., spoke regarding the parking of vehicles without engines, vans, trailers and boats on his street and expressed frustration with code compliance and the Sheriff's Department. Michael P. Neufeld, 13172 Poway Rd., representing the Poway Chamber of Commerce, invited those present to attend the annual Holiday Sundowner, Thursday, December 2nd at the Performing Arts Center. Ed Schaefer, 15151 Crocker Road, spoke regarding the Poway Grade and heavy truck traffic that still exists even after the opening on Scripps Poway Parkway. Steven Boyack, 14418 Crestwood Ave., spoke regarding litter and evidence of illegal encampments on the trails above Meadowbrook Middle School. He also related an incident involving the City's paving contractor in the Powers and Frame Roads area.' Don Parent, 8330 Century Park Ct., representing SDG&E provided an update on the MOU for right-of-way work within the City. CONSENT CALENDAR Mayor Cafagna noted that Item 12 was being pulled for discussion. Motion by Councilmember Higginson, seconded by Councilmember Goldby, to approve the Consent Calendar as follows: Ratification of Warrant Registers for the periods of October 25-29 (Continued from November 16, 1999 Item #6), November 1-5 and November 8-12, 1999. (401-10) Approval of Minutes - City Council November 4, 1999 - Adjourned Regular Meeting November 9, 1999 - Regular Meeting Approval of Amendment of Predevelopment Loan Agreement with the Brookview ' Senior Housing Partnership. (602-01 #279R) 10. Adoption of Resolution No. R-99-35 - Finding that Planning and Administrative Costs Charged to the Housing Fund in FY 1998-99 Were Necessary to Increase, Improve and Preserve the Supply of Low- And Moderate- Income Housing; and Resolution No. 99-093 - Finding that Housing Fund Monies Used Outside the Project Area For Planning and Administrative Costs in FY 1998-99 Were of Benefit to the Project Area. Approval of a Consultant Agreement between the City of Poway and Harper & Associates Engineering, Inc., for Design and Inspection Services for Reservoir Rehabilitation Projects at various locations throughout the City. (602-01 #1376) 13. Award of Bid for a Changeable Message Sign Board to Acme Safety and Signal in the amount of $17,886.50. (602-01 #1377) 14. Acceptance of Renovation of Starridge Park Playground from Court Concepts, Inc. and Appropriation of $4,904.48 from the Unappropriated General Fund Reserve. (602-01 #1323) 15. Adoption of Resolution No. 99-094 - Approving an Application to the Urban Forestry Grant Program Through the California Trees for the Millennium Initiative Funded Through the Forest Improvement Fund for the Twin Peaks Road/Pomerado Road Tree Replanting Project. (401-30) Motion carried unanimously. ITEM 1 (701-04) ORDINANCE NO. 519/FIRST READING STOVVE DRIVE SPEED LIMIT Mayor Cafagna opened the public hearing and read the title of Ordinance No. 519, "An Ordinance of the City of Poway, California, Amending Section 10.32.010 of the Poway Municipal Code to Establish a 45 MPH Speed Limit on Stowe Drive, from Pomerado Road to Scripps Poway Parkway." There was no one present wishing to be speak. Motion by Councilmember Higginson, seconded by Councilmember Goldby, to continue the public headng to December 14, 1999 for second reading and adoption. Motion carried 4-1 with Councilmember Rexford voting no. ITEM 2 (203-21) INITIATION OF SPECIFIC PLAN AMENDMENT 84-01QQ INDUSTRIAL PARK LAND USE DESIGNATION Staff report by City Manager Bowersox. The proposed amendment would allow more intense uses such as office buildings and to develop appropriate standards. A traffic Page 6788 4 - CITY OF POWAY - November 30, 1999 analysis has been prepared showing that an additional 202 acres of Office Park uses could be accommodated and still be within the 1998 EIR forecasted ADT volume of 134,262. Motion by Councilmember Goldby, seconded by Councilmember Higginson, to adopt Resolution No. 99-095, entitled, "A Resolution of the City Council of the City of Poway, California Initiating an Amendment to the South Poway Specific Plan to Allow Additional Office and Similar Uses in the Industrial Park (IP) Area, Specific Plan Amendment (SPA 84-01QQ)." Motion carried 3-2 with Deputy Mayor Emery and Councilmember Rexford voting no. ITEM 3 (203-21) INITIATION OF SPECIFIC PLAN AMENDMENT 84-01RR SOUTH POWAY COMMERCIAL SIGN REGULATIONS Staff report by City Manager Bowersox. The sign criteria for commercial single tenant and multi-tenant buildings as required by the South Poway Specific Plan Development Standards may present unintended difficulties for businesses in obtaining adequate signage. Motion by Councilmember Goldby, seconded by Councilmember Higginson, to adopt Resolution No. 99-096, entitled, "A Resolution of the City Council of the City of Poway, California Initiating an Amendment to the South Poway Specific Plan, Specific Plan Amendment (SPA 84-01RR)." Motion carried 3-1 with Councilmember Rexford voting no and Deputy Mayor Emery away from the dias. ITEM 4 (203-08) CONDITIONAL USE PERMIT 85-03M(3) - POWAY TOYOTA CONDITIONAL USE PERMIT 84-09 ~ POWAY HONDA Staff report by City Manager Bowersox. Staff continues to receive complaints from residents surrounding Poway Honda and Poway Toyota. Based on these unresolved issues, staff is bringing forward the conditional use permits for Council to consider scheduling public hearings for modification or revocation. The following people were present wishing to speak: Barry Boquist, 13325 Cicero Ct., expressed concerns with employee parking on the dirt lot at the rear of the dealership. Eileen LaLone, 13307 Via Mark, expressed concerns with car carriers using the loop of Ann O Reno, Jean O Reno and Olive Tree for unloading of cars. 6789 Page 5 - CITY OF POWAY - November 30, 1999 Mary Shepardson, 13815 Johannesberg Dr., #1, expressed concerns with the paging system and unloading of cars during the night. She then submitted a letter from neighbor, Betty Luce. Timothy Zaitz, 14087 Jean-O-Reno Rd., expressed concerns with lights, test ddving of cars through the neighborhood by mechanics and test drivers, noise from air compressors, power washing of cars at night, parking in neighborhoods by employees and car carriers passing through the neighborhoods. Linda Bradbury, 13303 Via Stephen, directly behind dealership, expressed concerns with the noise of the paging system, noise from air compressors during daytime, lights shining directly into her house, employees parking on the north side of the residential street blocking driveways, the safety of children getting off school busses, unloading of cars during the eady morning hours of 2-3 a.m., an incident on the south side of street - spray painted car on street. She also stated that the repair garage does not contain air compressor noise. Dwight Ritchey, 19129 Avenida La Valencia owner of dealerships, apologized to neighbors and pledged to address items the neighbors brought up. Motion by Deputy Mayor Emery, seconded by Councilmember Rexford, to continue this item for 60 days, staff to provide a list of all concerns expressed to Mr. Ritchey, who in turn is to provide a written status report to Council within 40 days. Motion carded unanimously. ITEM 5 (1180-05) STATUS REPORT DOMESTIC VIOLENCE COUNSELING PROGRAM Staff report by City Manager Bowersox. Council approved the initiation and funding of two distinct family service programs and a staff development workshop provided through For Parents' and Kids' Sake. This report provides an overview on the implementation of the programs and recommends continued funding by the City of Poway. Motion by Councilmember Rexford, seconded by Deputy Mayor Emery, to continue City funding for the programs. Motion carried unanimously. 679O Page 6 - CITY OF POWAY - November 30, 1999 ITEM 12 (203-10) MINOR DEVELOPMENT REVIEW 99-106 HILLSlDE/RIDGELINE APPLICANT: TIM CONNOLE Deputy Mayor Emery disqualified himself from participation on this item as he owns easements that abut the proposed project. He left the Council Chambers. Introduction by City Manager Bowersox. Staff report by Development Services Director Fritz. This is a request to construct a 5,250 square foot single story residence and a 1,750 square foot detached barn/workshop on a vacant 3.09 acre property located at the eastedy terminus of Orchard View Lane. The Engineering Division proposed that the following conditions be added to the project resolution of approval: C) Compliance with the following condition is required prior to issuance of the building permit: 21. The applicant shall provide to the City an executed copy of a road construction and maintenance agreement for Golden Sunset Lane and Orchard View Lane; D) Compliance with the following is required prior to issuance of Certificate of Occupancy for the new house: 29. Improvement pans for the water lines shall be prepared on standard sheets of mylar by a registered civil engineer and submitted for approval to the Director of Development Services. Plan check and inspection fees shall be paid by the developer. 30. Record drawing, signed by the engineer of work, shall be submitted to Development Services prior to a request of occupancy, per Section 16.52.130B of the grading ordinance. Record drawings shall be submitted in a manner to allow the City adequate time for review and approval prior to issuance of occupancy and release of grading securities. The following people were present wishing to speak: Tom Teal, 15131 Country Hill Rd., lives below the development, expressed concerns with fill being brought in, the proposed retaining wall and monitoring of the green belt area and traffic leaving the intersection of Golden Sunset and Espola. Vicki Gowey, 14440 Golden Sunset, is not concerned with development, but is concerned with street maintenance and damage to her driveway by adjacent developers as well as traffic impacts. Bob Boone, 15140 Country Hill Rd., spoke in opposition to the proposed project and expressed concerns with Poway Municipal Code Sections 12.20.060 and 12.20.120 he feels are being violated. The additional fill material has already been brought in, after grading, the western slope was brushed off which will cause flow into seasonal creek directly below where other homes are located. Developer fees should go to improvement of intersection at Golden Sunset and Espola. The property needs to be inspected by staff 6791 Page 7 - CITY OF POWAY - November 30, 1999 against something current rather than 1980 resolution. Would enter into road maintenance agreement after Mr. Connole repairs damage already done by his development. Tim Connole, 4570 Conrad, La Mesa, applicant, addressed concerns expressed by neighbors and responded to questions of the Council. Motion by Councilmember Higginson, seconded by Councilmember Rexford, to adopt Resolution No. P-99-84, entitled, "A Resolution of the City Council of the City of Poway, California Approving Hillside/Ridgeline Minor Development Review 99-106 Assessor's Parcel Number 321-031-29," with the added condition that if damage is determined by the City Engineer to Golden Sunset or Orchard View Road to be attributed to this project, it shall be repaired to the satisfaction of the City Engineer pdor to occupancy. Motion carried 4-0 with Deputy Mayor Emery disqualified. Deputy Mayor Emery returned to the Council Chambers. CITY MANAGER ITEMS City Manager Bowersox introduced new City Planner, Patti Brindle. MAYOR AND CITY COUNCIL-INITIATED ITEMS 18. Deputy Mayor Emery stated that skateboard enthusiasts had removed a section of fence and are using the drainage ditch on Espola Road near Blue Haven. He also reported a damaged section of woodcrete with exposed rebar on Midland Road near George's Foreign Auto Repair Shop.
