MINUTES OF THE CITY COUNCIL REGULAR MEETING
JANUARY 18, 2000.
The January 18, 2000, regular meeting of the City Council of the City of Poway, was
called to order at 7:00 p.m., by Mayor Cafagna at the City Council Chambers, 13325 Civic
Center Drive, Poway, California.

PUBLIC ORAL COMMUNICATIONS
Mayor Cafagna explained the procedure for Public Oral Communications. The following
person was present wishing to speak:
Jack Bloom, 12017 Tretagnier Circle, San Diego, representing: Pace TV, inquired as to
why their program on Channel 16, Time Warner, was being blacked out in Poway.

CONSENT CALENDAR
Motion by Councilmember Goldby, seconded by Councilmember Rexford, to approve the
Consent Calendar as follows:
Ratification of Warrant Register for the periods of December 20-24 and December
27-31, 1999. (401-10)
Approval of Reclassification of the Secretary to the City Manager to Executive
Assistant to the City Manager effective January 1, 2000. (503-03)
Approval of Classification Changes for Public Services Division 402 Management
Aide and Landscape Maintenance Supervisor to Benefit Assessment District
Specialist effective retroactive to January 27, 1999. (503-03)
Approval of two year contract extension with Pomerado Publishing for Poway Today
newsletter at current unit cost and increase in quantity printed. (602-01 #177A)
Motion carried unanimously.
ITEM 1 (701-04)
ORDINANCE NO. 522/FIRST READING
NON-RESIDENTIAL SEWER CLASSIFICATION
Mayor Cafagna opened the public hearing and read the title of Ordinance No. 522, "An
Ordinance of the City of Poway, California Amending Section 13.03.010 of the Poway
Municipal Code by the Addition of a New, Non-Residential Sewer Classification."
Introduction by City Manager Bowersox. Staff report by Administrative Services Director
Shafer. This classification is for customers who use significant amounts of water in the
production or process of making a product and which is not returned to the sewer system.
There was no one present wishing to speak.
Motion by Councilmember Emery, seconded by Councilmember Rex'ford, to continue the
public hearing to February 1, 2000 for second reading and adoption. Motion carried
unanimously.

VARIANCE 99-19
APPLICANT: DAVID DAVIS/OLD COACH REALTY
Mayor Cafagna opened the public hearing. Introduction by City Manager Bowersox. This
is a request for a variance to allow up to a 24 foot front yard setback rather than the
required 40 foot setback for Lots 6, 14, 20, 29, 47, 52 and 63 in the Heritage Golf Estates
Subdivision located on the east side of Old Coach Road and east and west sides of Old
Coach Drive, north of Espola Road.
The following person was present wishing to speak:
Jeanne Selis, 13633 Action Avenue #B, representing McCullough-Ames Dev. spoke
in support of the request.
Motion by Councilmember Goldby, seconded by Deputy Mayor Higginson, to close the
public hearing and adopt Planning Resolution No. P-00-09, entitled, "A Resolution of the
City Council of the City of Poway, California Approving Variance 99-19 Assessor's Parcel
Numbers 277-200-06, 14; 277-201-06, 15; 277-202-08, 13, 24." Motion carried
unanimously.
ITEM 2A (701-11 )
SENATE BILL 329 (PEACE)
SAN DIEGO REGIONAL INFRASTRUCTURE AND TRANSPORTATION AGENCY
Staff report by City Manager Bowersox. This bill would establish the San Diego Regional
Infrastructure and Transportation Agency (RITA) in the San Diego region. The proposed
agency would perform the responsibilities of the San Diego County Air Pollution control
district, the San Diego Association of Governments, the San Diego Metropolitan
Transportation Development Board, the North San Diego County Transit Development
Board, the San Diego Unified Port District, and the Infrastructure Financing Districts in the
Border Development Zone.
General discussion ensued with concems being expressed on the creation of an additional
layer of government.
Motion by Deputy Mayor Higginson, seconded by Councilmember Rexford, to request that
Senator Peace provide additional opportunity for dialogue, hearings, and analysis in
consideration of the far reaching implications of this complex legislation and offer Poway
as a location for the forum. Motion carried unanimously.

CITY ATTORNEY ITEMS
8. City Attorney Eckis requested a Closed Session for one case of Anticipated
Litigation under Government Code §54956.9(c) and stated a report out was not
expected.
City Attorney Eckis then announced that an agreement had been reached on
purchase price making the Resolution of Necessity, adopted last Tuesday,
unnecessary.
MAYOR AND CITY COUNCIL-INITIATED ITEMS
13. Mayor Cafagna requested and received concurrence for the appointment of
Anthony Pagano as Councilmember Goldby's appointee to the Housing
Commission.
CLOSED SESSION
Mayor Cafagna called for a Closed Session at 7:40 p.m.
CALL TO ORDER AND ADJOURNMENT
Mayor Cafagna reconvened the meeting with all members present, then adjourned the
meeting at 8:00 p.m. on motion by Councilmember Goldby, seconded by Deputy Mayor
Higginson.
