There was no one present wishing to speak. ITEM 1 (1601-02) PRESENTATION- WATER TREATMENT PLANT CHEMICAL RISK MANAGEMENT PROGRAM Introduction by City Manager Bowersox. Staff report by Public Services Director Howell. In accordance with the Clean Air Act Amendments of 1990, the EPA finalized the Chemical Accident Prevention Provisions regulation (40 CFR Part 68) on June 21, 1996. This regulation requires facilities that handle regulated substances prepare and submit a Risk Management Program (RMP) on or before June 21, 1999. The Occupational Health and 6831 Page 2 - CITY OF POWAY - January 20, 2000 Safety Administration finalized the Process Safety Management standard (29 DFR 1910.119 or 8 CCR 5189) in May 1992. This regulation requires facilities to develop management programs for handling certain regulated substances. There was no written submittal requirement; a facility must simply develop and implement these programs at their facility. Since our facility handles in excess of 2,500 pounds of chlorine, we are required to comply with both. Next, Lee Pyle, Program ManagerNice President of Tracer Environmental Technologies provided a brief overview via power point presentation of the process and responded to questions of the Council. Water Utilities Manager Hilliker provided a brief overview of the procedures in the event of off-gassing action. ITEM 2 (1110-02) POMERADO ROAD SOUND WALL Staff report by City Manager Bowersox. The Pomerado Road project was originally put together as a road widening and repair project, including extensive storm drain improvements. Halper Road residents approached the City Council requesting a sound wall (located on the west side of Pomerado Road between Glen Oak Road and 600 feet north of Vaughan Road) be included in the project. The purpose is to reduce the noise level coming from Pomerado Road. With the last budget, additional funding (approximately $1,000,000) was appropriated to install a sound wall and landscaping to be maintained by the City. Staff has determined that a sound wall at the top of the existing slope would be the least costly design, however would require the acquisition of easements to install and maintain the wall in that position. Development Services Director Fritz provided a review of the Halper Road neighborhood meetings outcome. The installation and location of a sound wall would effect 30 property owners. About one-third were present at a meeting November 18, 1999 to review the latest design and discuss the need for easements and the formation of a Landscape Maintenance District. Some object to the installation on top of slope and requested consideration of other options. They expressed a desire for a sound wall next to the sidewalk. A few objected to granting the needed easements. Others did not support formation of a Landscape Maintenance District but were not opposed to the proposed wall location. After receiving feedback, staff analyzed 3 options. Option 1 is to install the sound wall on top of slope as recommended by the sound study. Also included is the slope landscaping and grants of easements. Alignment of the wall would be the same as the existing fences with one exception. Option 2 is to install the wall next to the sidewalk at the bottom of slope which requires a height of up to 16 feet in some areas. The wall would have to be a combination retaining wall and sound wall to accommodate backfill behind the wall. Option 3 is to install the sound wall halfway in between the top of slope and the sidewalk with the visible height of up to 11 feet above ground. Option 1 is what would be done if the homes were being built today, the cost of the wall would be included in the sale of the property. This is the only option that meets the General Plan requirements. 6832 Page 3 - CITY OF POWAY - January 20, 2000 The following people were present wishing to speak: Gerald Schimke, 14211 Halper Road, spoke in support of Option 1. Diane Etchings, 14057 Halper Road, spoke in support of Option 2. Richard Jones, 14149 Halper Road, spoke in opposition to the installation of a wall. David Cave, 14038 Halper Road, spoke in opposition to the placement of a wall anywhere other than on the property line. John Rezer, 14003 & 14009 Halper Road, spoke in support of Option 2 with landscaping like across the street. Ed Shafer, 15151 Crocker Road, owns a home on Halper Road, spoke in support of Option 2 with landscaping. Motion by Councilmember Emery, seconded by Deputy Mayor Higginson, to direct staff to include Option 1 with the Pomerado Road widening project for those who wish to participate. Motion carried 4-1 with Councilmember Goldby voting "no". ITEM 3 (203-18) PRE-GENERAL PLAN AMENDMENT 00-01 Introduction by City Manager Bowersox. The process for a Pre-GPA was established to give the applicant a sense of the Council's opinion of a project prior to expending funds and making formal application. The statements made by the Council are not binding and no decision is made on the project. Pre-GPA 00-01A Applicant: Frederick Einer Southeast corner of Robison Boulevard and Pomerado Road The applicant is requesting consideration of a General Plan Amendment for a 7.17 acre parcel. The property is currently split-zoned with approximately 14 acres of undisturbed land designated RR-A. The remaining three acres, excavated for its matedal and generally flat, is zoned RS-7. Under the proposed request, an increase in density from RR-A to RA would be subject to Proposition FF, requiring a vote of the people to approve a formal redesignation. The following person was present wishing to speak: Peter Epstine, 2634 Miller Avenue, Escondido, representing: Palomar Enterprises, inquired as to how the current zoning was established. Pre-GPA 00-01B Applicant: Jerry Richardson/City of Poway Vista View Drive, approximately 350 feet south of Poway Road 6833 Page 4 - CITY OF POWAY - January 20, 2000 The applicant is requesting consideration of a General Plan Amendment for a 1.01 acre parcel. He currently owns the automotive dealership to the north and is requesting a change in zoning of the subject parcel to secure the additional acreage necessary to accommodate an area for the storage of new cars. Although the parcel is approximately 140 feet deep, Mr. Richardson is proposing to use only the northerly 40 feet for vehicle storage, leaving the remaining 100 feet for the continued use of the Community Garden. A covenant could be recorded against the property to prevent future expansion of commercial land uses. The following people were present wishing to speak: Philip Giesing, 13801 Poway Road, spoke in opposition. Samuel Blagovich, 13105 Vista View Drive, spoke in opposition. Deneen Wilhelmi, 13109 Vista View Drive, spoke in opposition. Cheryl Mesler-Rutherford, wife of co-owner Wayne Rutherford of Richardson auto dealership and owner of Mesler Construction Inc., 294 Shasta Street, Suite A, Chula Vista, spoke in support. Council consensus was no interest in either proposal. ITEM 4 (203-11 ) DRAFT 1999-2004 HOUSING ELEMENT UPDATE Introduction by City Manager Bowersox. The Draft Housing Element Update has been prepared by the City's planning consultant, Reba Wright-Quastler with input from staff. Planning Consultant Quastler, provided a brief overview presentation of the update and responded to questions of the Council. The update was prepared in accordance with the provisions of state housing law and covers the five-year housing element cycle from 1999 through 2004. The updated element includes five major sections as follows: - Introduction - Needs Assessment - Review of Previous Housing Element - Goals, Policies and Strategies - Action Program It is recommended that Council discuss the Draft 1999-2004 Housing Element Update and following the mandatory 45-day public review period, a public hearing will be scheduled for the adoption of the Housing Element Update. The following people were present wishing to speak: 6834 Page 5 - CITY OF POWAY - January 20, 2000 Ed Carboneau, 14073 Pomegranate Avenue, expressed his views on affordable housing. Chris Cruse, 13734 Utopia Road, made inquiry regarding the statistics in the report, expressed her view on the overall report and the need to look outside of South Poway for affordable housing sites.
