CC 2000 03-28 CITY OF POWAY, CALIFORNIA MINUTES OF THE CITY COUNCIL REGULAR MEETING MARCH 28, 2000 The March 28, 2000, regular meeting of the City Council of the City of Poway, was called to order at 7:00 p.m., by Mayor Cafagna at the City Council Chambers, 13325 Civic Center Drive, Poway, California. PRESENTATIONS Mayor Cafagna presented a check for $500 to Nick Anastas, representing the Rancho Bernardo High School Grad Nite 2000 Committee. Mayor Cafagna presented a Proclamation declaring the month of April 2000 as "Emergency Preparedness Month" to Safety Services Director Sanchez. 6888 Page 2 - CITY OF POWAY - March 28, 2000 PUBLIC ORAL COMMUNICATIONS Mayor Cafagna explained the procedure for Public Oral Communications. The following people were present wishing to be heard: James T. Cavanaugh, 12937 Oak Knoll Road, spoke regarding a recent newspaper article in which he took offense to the references made about a valued employee. Tammie Kennedy, 13012 Creek Vista Drive, spoke regarding a recent newspaper article in which she took offense to the references made about a valued employee. Bill Cross, 13105 Corona Way, announced that Connie Brock will be leaving the Senior Center at the end of the month. CONSENT CALENDAR Councilmember Rexford requested Item 9 be removed from the Consent Calendar for discussion. Motion by Councilmember Goldby, seconded by Deputy Mayor Higginson, to approve the remainder of the Consent Calendar as follows: 3. Ratification of Warrant Register for the period of Mamh 6-10, 2000. (401-10) Approval of Appropriation of $39,071 in Funding from the General Fund for Local Law Enforcement Block Grant, of which $35,202 will be repaid by the Grant. (401-30) Approval of Reduction of the Grading Secudty (G1216-99) for Poway Summit Estates, TTM 89-05, subject to the receipt of substitute securities; McCullough-Ames Development, Inc., Applicant. (701-11) 10.3 Adoption of Resolution Nos. 00-019 and R-00-08 (1 City/1 Agency) Appreving the Appropriation of $232,500 for the Acquisition of a .23 Acre Lot and Single Family Dwelling Located at 14025 Brighton Avenue. (1002-01R) Motion carried unanimously. ITEM 1 (203-10) MINOR DEVELOPMENT REVIEW 99-182R APPLICANT: ROBERT KRAUSE Mayor Cafagna opened the public hearing. Staff report by City Manager Bowersox. This is a request for a revision to a minor development review appreval to raise the pad height by 5 feet, to expand the pad area with a 16 foot high manufactured slope, and to reduce the Fire Management zone on an undeveloped residential lot at 14380 Ciera Court. There was no one present wishing to speak. Motion by Councilmember Goldby, seconded by Councilmember Emery, to close the public hearing and adopt Planning Resolution No. P-00-24, entitled, "A Resolution of the City Council of the City of Poway, California Appreving MDRA 99-182R Assessor's Parcel Number 277-201-19." Motion carried unanimously. ITEM 2 (205-04) STATUS OF GENERAL FUND BUDGET MIDYEAR BUDGET ADJUSTMENTS FOR 1999-00 Staff report by City Manager Bowersox. Council approved the FY 1999-00 Financial Program and established a General Fund Budget on June 29, 1999 in which revenues 689O Page 4 - CITY OF POWAY - March 28, 2000 exceeded expenditures by $543,951. The Financial Program established an operating budget of $43,158,750 and a Redevelopment/Housing Services operating budget of $5,204,040. In addition the Program funded $9,105,350 for the City and Redevelopment Agency capital improvement projects. The upturn in the economy over the past few years has finally started to affect the assessed values of property within the City. The result is the estimated General Fund Property Tax Revenue is approximately 5% higher than anticipated. Additionally Sales Tax Revenue is projected to be approximately 16% over the original budget. Finally, development fees are coming in at approximately 13% over the budgeted amounts. The General Fund expenditure level increases from an approved budget of $20,320,469 to $20,681,851. The major components of the increase are related to development and public safety. Both of these increases are substantially offset by revenues, with increases in public safety overtime being partially offset by mutual aid reimbursements. Adjustments to the Redevelopment Agency budget include $20,030 in funding for position upgrades and additional staff responsible for housing administration. In summary, staff is projecting that fiscal year 1999-00 will close with a General Fund surplus of $2,068,410. City Manager Bowersox then noted a correction to page 12 of 15, wherein the Sales & Service amount of ($1,100,000) should be ($60,000). Motion by Councilmember Goldby, seconded by Councilmember Emery, to adopt Resolution No. 00-020, entitled, "A Resolution of the City Council of the City of Poway, California Approving Midyear Budget Amendments for Fiscal Year 1999-2000," and Resolution No. R- 00-09, entitled, '% Resolution of the Poway Redevelopment Agency Approving Midyear Budget Amendments for Fiscal Year 1999-2000." Motion carried unanimously. 2.2 (203-11 ) HILLSIDE/RIDGELINE REPORT HILLTOP PROTECTION Introduction by City Manager Bowersox. Staff report by Development Services Director Fdtz. At the Council meeting of November 16, 1999, Council requested information regarding development projects occurring on hillside, ridgeline and hilltop areas. They also inquired as to methods (such as planting trees) to effectively screen or detract the public view of such developments. Two development projects were identified including a new house being constructed above Rattlesnake Canyon and a new subdivision at the northwest corner of Poway Road Grade and Espola Road. These projects, as well as the applicable General Plan policies and City ordinances related to the City's natural topographic features are discussed in the report presented. The home being constructed above Rattlesnake Canyon 6891 Page 5 - CITY OF POWAY - March 28, 2000 included a CUP and MDRA in the development applications which were approved by Council on June 10, 1997. The new subdivision at the northwest corner of Poway Road grade and Espola Road was approved on April 30, 1991. The final time extension for this tract map was approved by Council on May 11, 1999. The City's first General Plan adopted in September 1983, included a Community Design Element. The element included Figure 9 which depicts "major topographical features" as well as Objective 16 and related policies regarding "hillside residential design." Additionally, the 1983 Land resource Conservation Element included a discussion, Objective 2, and related policies regarding "land forms, ridgelines, and hillsides." The General Plan Update adopted in November 1991 included additional strategies aimed at further protecting the City's significant topographical features. In April 1985, Council approved Resolution No. 85-019 which indicates that Minor Development Review Applications (MDRA) lying within the shaded areas described as major topographical features, shall be included as regular agenda items for Council approval. Following that action, staff prepared submittal requirements for hillside/ridgeline MDRA's. In March 1986, Council considered General Plan Amendment/Zoning Ordinance Amendment GPA/ZOA 86-01 and proposed Ordinance 187 related to the City's major topographical features and requirements for hillside/ridgeline protection. The proposed amendments and ordinance were not adopted. The Council considered this item at three previous meetings. The 1991 General Plan Community Development Element Policy G - Landscaping, includes Strategy 3 which states, "The front yard area of all single-family homes shall be fully landscaped." The City does not currently review or approve landscape plans for single- family homes. However, the "visual impact analysis" required by the General Plan is prepared by the applicant and reviewed by the project planner. Appropriate mitigation measures are required and implemented by the project developer if the analysis identifies any significant adverse visual impacts. This analysis may identify the need for planting trees around a proposed hillside home development to effectively screen or detract the public view of such development. The council has the discretion to require such tree planting if deemed necessary and appropriate. Also, existing rock outcroppings may be an effective means of providing screening, as long as the structure is sited properly. The City's policy for hillside grading is to allow grading based on the natural slope of the graded area. The greater or steeper the slope, the less grading is permitted. General discussion ensued. 6892 Page 6 - CITY OF POWAY - March 28, 2000 Motion by Councilmember Goldby, seconded by Councilmember Emery, to direct staff to bring back a draft ordinance on hillside ridgeline protections to a future workshop. Additionally, staff to create an inventory for a proposed hillside overlay. Motion carried unanimously. MAYOR AND COUNCIL-INITIATED ITEMS 13. 14. Councilmember Emery noted the recent citizen requests for bus benches on comment cards. Council concurred to evaluate the distribution, and the condition of City bus benches and shelters. Councilmember Goldby requested consideration for including the current Poway Today on the City's website; noted early morning traffic congestion on Pomerado Road due to the traffic control devices for the construction of the soundwall and requested staff prepare a memo on the options/constraints for managing traffic during construction along major arterials. He also noted that the wall along Pomerado Road south of Metate appears massive due to lack of landscaping and requested an evaluation of constructing landscape planters for placement along the wall. 17. Councilmember Rexford requested an update on the City's inclusionary zoning requirements and options for expending the current balance of Housing In Lieu funds.
