AN ORDINANCE OF THE CITY OF PO~I~Y, CALTMDRNIA
TO ESTABLISH THE CITY GOUNCIL AS
PLANNING GO[~4ISSION FOR PURPOSES
OF ~T.L R~DEgRIOPMENT ~l~'l'rM ~ ACTIVITIES
THE CITY GOUbK~IL OF THE CITY OF PO$~AY DOES ORDAIN AS FOLLOWS:
Section 1. City Council finds and determines that California Health and
Safety Code Sections 33300 and 33301 require that before any area is designated
for redevelopment, the co,,,~nity authorized to undertake the development [m3st
have a Planning Con~ission.
Section 2. Pursuant to California Government Gode Sections 65100 and 65150,
the City Council hereby establishes itself as the Planning Go,mission for pur-
poses of all redevelolmnent matters and activities to be carried out in compli-
ance with the California Go~,,~nity RedeveloImment Law (California Health and
Safety Gode Section 33000 et seq. ). Said Planning Conm%ission shall consist of
the five (5) members of the City Council now serving or hereinafter elected, and
said Councilmembers shall serve on the Co~mission for the duration of their
respective Council terms.
Section 3. Severabilit¥. If any section, subsection, subdivision, sentence,
clause, phrase or portion of this ordinance or the application thereof to any
person or place, is for any reason held to be invalid or unconstitutional by the
decision of any court of competent jurisdiction, such decision shall not affect
the validity of the remaining portions of this ordinance or its application to
other persons or places. The City Council hereby declares that it ~ould have
adopted this ordinance in each section, subsection, subdivision, sentence,
clause, phrase or portion thereof, irrespective of the fact that any one or more
sections, subsections, subdivisions, sentences, clauses, phrases or portions, or
the application thereof to any person or place, be declared invalid or unconsti-
tutional.
Section 4. The City Clerk is hereby ordered and directed to certify to the
passage of this ordinance and to cause the same to be published once in a news-
paper of general circulation, printed, published and circulated in the City of
Poway o

City of Poway held the 13th day of September, 1983, and thereafter PASSfD AhI)

September, 1983, by the following roll call vote:
