the ,aPRroval of a building permit to construct a 1600~square~fo6t, detached I/Iiorkshop
and storage stru~ture on the referel}ced, proRerty l:lY the City of Poway, ("CITY"
hereinafter)" OWNERS hereby agree that the workshop and storage structure is non-
hCitJitable sp,!ce. Sai.dworkshop and,~toragestructure'shall notbe used for cbmm~'m;ial
purposes except, imaccordancefwith the Home Occupation Permit provision as ,listed in
Section 17.28.010 of the Poway Muhicipal Code.
This Covenant shall. run with the land and be binding upon and inure to the
benefit of the .future owners,encumbrances, successors, heirs, personal
rep'resentaiives, transferees and"assigns'of the respeciiveparties.
In theevent'that ,building permits are never obtained to construct the. proposed
ai:ldition atthe requestofthe OWNERS, the CITY,snall,expungethis Covenanffrom the
record title of the PROPERTY
If eitherpaity is required to in'cuf'costs to enforce the provisions of this Covenant,
the prevailing party shall be entitled to full reinib,lJ[sement of all costs, 'including
reasonable attorneys' fees, from the other ,party The CITY may assign to persons
impacted by the performance of this Covenant the right to. enforce this Covenant against
OWNERS.
