COVENANT REGARDING REAL PROPERTY
APRO, LLC, a Delaware limited liabjEty company; Ovvn~r,("OWNER" h~reinafter) is the owner of
land described in Exhibit A, which is 'attached hereto and 'made a part hereof and which ,is commonly
known as Assessors Parcel NLimoers '31.7-540-15 and 317-540,16 located at 12462 Poway Road,
Poway, CA ("PROPERTY hereinafter). In consideration 'of 'approval for a building permit to raise the

existing canopy located above the gasoline pump islands and perform other associated modifications to
the gasoline station located on PROPERTY in the City of Poway ("CITY" hereinafter), OWNER hereby
agrees to the following:
(a) Paving shall not be installed north of the block wall or within any planter areas shown on
the site plan (Exhibit B) without prior CITY authorization;
(b) The parking of vehicles an'd storage of any type of,materiais on the portion of PROPERTY
located north of the wall shown on Exhibit B are strictly prohibitedwithouf prior CITY authorization,
(c) To undertake all reasonable actions to prevent,t~~'parking of vehicles and storage of any
type of materials on the area located north ofthewall shown on Exhibit B;
(d) To maintain the area,north of the wall shown on Exhibit B; and
(e) Disturbance or removal of vegetation growing between the north property line of
PROPERTY and the previously disiurbedland shown on' Ex~ibit B are prohibited without prior CITY
authorization.
This CoVenant shall run with the land and be tiinding upon and inure to the benefit of the future
oWl'lers, encumbrances, 'successors, heirs, personal representatives, transferees and assigns 'of the
respective.parties.
If eith~r partY is required to incur costs to ~nforce the provisio of this Covenant, the prevailing
