RESOLUTION NO 02-017
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF POWAY, CALIFORNIA,
ORDERING THE EXPANSION OF POWAY LANDSCAPE MAINTENANCE
DISTRICT NO 86-1 AND CITY OF POWAY LIGHTING DISTRICT,
ZONES A AND C, WITH THE ANNEXATION OF
APNS 272-140-03, 272-140-04, 272-150-01, 276-071-14,
277-011-08, 277-011-10, 277-011-11, 321-100-01, AND 321-100-08
BY WRITTEN CONSENT OF PROPERTY OWNER
WHEREAS, the City Council of the City of Poway desires to expand Poway
Landscape Maintenance District 86-1 and City of Poway Lighting District, Zones A and C,
as shown in Exhibit A pursuant to the Landscaping and Lighting Act of 1972; and
WHEREAS, the record owner of all of the real property within said expansion area
has given written consent to the proposed formation and annexation into Poway
Landscape Maintenance District 86-1 and the City of Poway Lighting District, Zones A and
C, pursuant to California Streets and Highways Code, Section 22608 1, and
WHEREAS, the public interest and convenience require the maintenance, service,
and operation of public landscape and lighting within said territory; and
WHEREAS, the City Clerk of the City of Poway is hereby directed to record this
document with the County Recorder of the County of San Diego
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Po way as
follows:
1 The foregoing recitals are true and correct, and the City Council so finds and
determines.
2. All of that certain territory shown in Exhibit "A" attached hereto is hereby
added by annexation into Poway Landscape Maintenance Assessment
District No 86-1 and City of Poway Lighting District, Zones A and C
PASSED, ADOPTED, AND APPROVED by the City Council of the City of Poway,
California, at a regular meeting this 26th day of February 2002.

CONSENT TO ANNEXATION
FOR THE INCLUSION OF PROPERTIES INTO
CITY OF POWAY LANDSCAPE MAINTENANCE DISTRICT 86-1
AND CITY OF POWAY CITY LIGHTING DISTRICT, ZONES A AND C
WHEREAS, the undersigned constitute(s) 100 percent ownership [or has legal signature
authority representing 100 percent ownership] of the property shown in Exhibit A, attached hereto,
and generally described as a portion of County Assessor Parcel Nos. 272-140-03-00, 272-140-04-
00, 272-150-01-00, 276-071-14-00, 277-011-08-00,277-011-10-00, 277-011-11-00, 321-100-01-00,
and 321-100-08-00, legally described as A subdivision of portions of the south half of Section 7
and the north half of Section 18, all in Township 13 south, Range 1 west and Lot 4, in Section
12, and the east half of the northeast quarter of Section 13 and Lots 1 and 2 in Section 13, all
in Township 13 south, Range2 west, San Bernardino base and meridian, in the City of Poway,
County of San Diego, State of California, according to United States government survey, and
all subsequent parcels created by any subdivision of said parcel; and
WHEREAS, the aforementioned property is proposed to be developed and will receive special
benefit from City [District]"maintained street lighting and landscaping; and
WHEREAS, the undersigned owner(s) do hereby consent to annexation into Poway
Landscape Maintenance District 86-1 and the City of Poway City Lighting District, Zones A and C,
pursuant to the California Streets and Highways Code Section 22608 1, and
WHEREAS, the undersigned owner(s) consent to assessments levied under the assessment
formulas as written within the yearly LMD 86-1 Engineer's Reports, and hereby acknowledges receipt
of the landscaping and lighting benefits to said property
PURSUANT to Section 22608,2 of the Streets and Highways Code of the State of California,
these properties will be included within the required Engineer's Report. The signing of this consent to
annexation precludes any and all notice and hearing requirements for the first year's Report,
