Whereas Bret E. Gossett, Property Owner ("OWNER" hereinafter) is the owner of real property
commonly known as Assessor's Parcel Number 321-420-06 C:PROPERTY" hereinafter), and more fully
described as:
LOT 6 OF CITY OF'POWAY TRACT MAP 89-05, IN THE CITYqF POWAY, COUNTY OF SAN DIEGO,
STATE OF CALIFORNIA, ACORDING'TO MAP THEREOF NO 14040, FILED IN THE OFFICE OF THE
COUNTY RECORDER OF SANDIEGO COUNTY, SEPTEMBER 20,2000.
In consideration ofthe approval by the City of poway ("CITY" hereinafter) of Minor Development
Review 00-089 involving construction ofa 5,290-square-foot single4amily residence, plus two detached 2-car
garages totaling 1 ,352-square-feet as a condition of TIM 89-05, OWNER hereby agrees'to the'following:
1) Installation of fire, sprinkler system is required in all .structures with living space, future
additions, and guesthouse;
2) Restriction of removal of native, vegetation in open space lot.
3) Maintenance of vegetation in accordance with the City of Poway's Wildland Fuel Management
'~- Mitigation Plan for iones'2, 3; and 4
4) Restriction of any permanent structures greater,than 2 feet in height other than fences, walls,
pools, and tennis courts within zone 4 of the Wildland Fuel Management.Mitigation Plan.
5) Resfriction of any permanent structures;including but not limited to: fences, walls, pools,
tennis courts,gaz~bm; in zones 1 though 3 oftheWildland Fuel Management Mitigation Plan.
6) No portion of any future,guest house shall everbe rented or leased as a separate unit, and
that'no kitchen facilities shall ever be installed.
This Covenant .shall rUr:J with the land and be binding upon and inure to the benefit of the future
owners, encumbrances, successors, heirs, personal representatives, transferees and assigns of the
respective parties.
In the event of litigation t() enJorce the provisions of".this Covenant, the prevailing party shall be'
entitled to full reimbursement of all costs,including reasonable,a"ttorneys' fees, from the other party
