Trust, ("OWNER" hereinafter) are the owners of real property described in Exhibit "A",
which is attached hereto and made a part hereof and which is commonly known as
Assessor's Parcel Number 2787240-21 ("PROPERTY,hereinafter), In consideration of
approval of Underground Waiver 01c01 by the City of Poway, ("CITY" hereinafter).
OYVNER ~ereby agrees for the benefit of the CITY, no,! to oppose any future private or
public, utilities undergrouhCling district, and to pay a pro rata share of future
undergrounding costs,
This Covenant shaW run with the land and bE:) binding upon and inure to the
benefit of the futu re owners, encumbrances, successors, heirs, personal
representatives, transferees and assigns of the respective parties.
If either party is required to incur costs to enforce the provisions of this Covenant,
the prevailing party shall be, entitled to full reimpursement of all costs; including
reasonable attonieys' fees, from the other party The CITY may assign to persons
impacted by the performance of this Covenant the rightto enforce this Covenant C]gainst
