COVENANT REGARDING REAL PROPERTY
Steven J. Caliguri and Lucinda B. Caliguri, husband and wife as joint tenants, Owners
("OWNER" herelnafter),of real,property which is commonly known as.Assessor's Parcel Number 277-
202'02-00, located at 14195 Biscayne Place, Poway,CA ("PROPERTY hereinafter) and more fully
described as:
Lot 41 of City of Po way Tract No, 89-13R, The HeritagePhase 1, Unit 1, in
the City of PowaYi cplJlity of San Diego, State of California, according to
Map thereof No" 13708, filed in the office of the'County Recorder of San
Diego, December'17, 1998.
Inconsideration of approval of a Building Permit to construct a 429-squar~-foot detached
guesthouse on the referenced property by the City of poway (':CITY" hereinafter), OWNER hereby
agrees that no portion of tne guesthouse shall ever be rented or leased, as a sepClrate unit and
kitchen facilities shall never.be installed.
This Covenant shalLrun with the land and,be binding upon,and inure to the benefit of the'future
owners, encuf]lbrances, successors, heirs, personal representatives, transferees and assigns of the
respective parties,
In the event that building Re~mits are never obtained t9 constru.ct the proposed addition at the
request of the OWNER, the CITY shall expunge this Covenant from the record title of the
PROPERTY
If either party ,is required to !incur costs to enforce the provisions of this 'Covenant, the
prevailing party ,shall be entitled tof':!ll reimburs~ment of allt;:o'sts, including reasonable attorneYs'
fees, from the other party The CITY may assign to persons' impacted by the perforll)ance of this
Covenantthe right to enforce this Covenant against OWNER
