("PROPERTY hereinafter), and, more fully described as:
Lot 47 of City of Poway Tract,Map 84-08, in the City of Poway, County of San Diego,
State of California, according to Map thereof No. 12044, filed in the office of the
County Recorder of San Diego County
In consideration of the approv91 by the City of Poway ("CITY" hereinafter) of a Building Permit to
construct an detached 720-square'foot' pool 'house, OWNERS hereby agree that no portion of the pool
house shall ever be rented or leased as a-separate unit and no kitchen facilities shall never be installed.
This Covenani shall run with the land and be binding upon and inure to the benefit of the future
owners, encumbrances, succes?ors, 'heirs,' personal representatives, transferees and assigns of the
respective parIies.
In the event that the Building Permit is never obtained to-construct the proposed addition, CITY
shall at the request of OWNERS expunge this Covenant from the record title of PROPERTY
If either party is required to' incur costs, to enforce the provisions of this Covenant, the prevailing
party shall be entitled to full reimbursement of all costs, inclu,ding reasonable attorneys' fees, from the
othe'r party The CITY mayassig~ top",rsons impacted by the performance of this Covenant the right to
enforce this Covenant against OWNERS.
