hereinafter) and more fully described as:
Lot 120 of Green VallElyEstatE?s Unit #9, in the County of San Diego, State
of California, according to Map thereof No, 4101, filed inthe Office of the
County Recorder of San Diego County, Feoruary 25, 1959
In consideration of approval ora Building Permit to construct a .300-square.foot detached pool
house on the referenced property by the City of Poway ("CITY" hereinafter), OWNER hElreby agrees
that no portion of the pool house shall ever be rented or ieased, as a separate unit and kitchen
'facilities shall never be installed,
This Covenant shall run with the land,and be binding upon and, inure to the benefitaf the future
owners, encumbrances, successors, heirs, personal representatives, transferees and assigns of the
respective parties.
In the event that building permits are never obtained to construct the proposed addition atthe
request of the OWNER, the CITY shall expunge this Covenant from the record title of the
PROPERTY
If either party is required to incur costs to enforce the provisions of this Covenant, the
prevailing, party shall be entitled to full reimbursemenLof all costs, including reasonable attorneys'
fees. from '.the other party, The C}TY may ,assign to Rersons impacted by the performance of this
Covenant,the right to enforce this Covenant against OWNER.
