COVENANT REGARDING REAL PROPERTY
R W Stavros and Fiona Stavros, as Trustees, of the Stavros Family Trust dated
February 10, 1998, Owners, ("OWNERS" hereinafter) are the owners of land described in
Exhibit A which is attached hE~reto ?nd made a part hereof and which is commonly known as
Assessor's Parcel Number 275-081-09 located at 13639 Jackrabbit Road, Poway, CA
("PROPERTY' hereinafter), In consideration of a building permit to convert a 456 square-foot
attached garage to a guest house on the referenced property by the City of Poway ("CITY"
hereinafter), OWNERS hereby agree that no portion of the guest house shall ever be rented or
leased as a separate unit and kitchen facilities shall never be installed.
This Covenant shall run with the land and be binding upon and inure to the benefit of the
future owners, encumbrances, successors, heirs, personal representatives, transferees and
assigns ofthe respective parties.
In the event that buildiilgpermits are never obtained to construct the proposed addition
at the request of the OWNERS, the CITY shall expunge this Covenant from the record title of
the PROPERTY
If either party is required to incur costs to enforce the prpvisions of this Covenant, the
prevailing party shall be entitled to full reimbursement of all costs, including reasonable
attorneys' fees, from the other party The CITY may assign to persons impacted by the
performance of this Covenant the rightto enforce this Covenant against OWNERS.
